邊境查驗程序對疫情的因應措施-以文件之補交或以電子傳輸取代交付正本之可行性為例

Response Measures of Border Inspection Procedures to Epidemic Situation -Take Late Turn in or Electronic Submission of Document as Example

摘要


2019年底,中國爆發了嚴重的肺炎疫情,隨後更擴散成為世界性的災難。我國雖未受嚴重打擊,然因為我國食品供應高度仰賴進口,從而,其他國家對於運輸、郵務之限制,乃至於政府機關暫停受理作業之情形,亦將嚴重危及我國食品之輸入。因此,按通常程序對輸入食品進行查驗,勢屬難行。因應疫情,官方所採取的暫行措施,又再發生合法性之疑義,有予以釐清之必要。本文經研究發現,目前官方容許業者以文件後補方式辦理之暫時性措施,尚屬符合現行法律框架;日後如有需要將暫行性措施常態化之需要,則現行法令亦已給予充分之授權。

At the end of 2019, severe COVID-19 pneumonia outbreak in China, and then spread to become a worldwide disaster. Although Taiwan is not severely impacted, restrictions on transportation and postal services of other foreign governments still seriously affect the food supply in Taiwan because Taiwan is highly dependent on food imports. Therefore, it is very difficult to check the imported food with to the usual procedures. The temporary measures taken by the authorities in response to the pandemic situation will again raise doubts about their legitimacy. According to this study, it is found that the temporary measures that allow applicants to turn in documents late comply with the current legal framework. If the need to normalize the temporary measures in the future is necessary, the current law has also given full authorization.
