中國大陸面對雙碳目標的政策措施研究-基於日本減碳政策的啟示

摘要


全球升溫已經導致氣候風險越來越高,氣候變化是人類面臨的全球性問題。中國大陸提出2030年碳達峰、2060年碳中和的雙碳目標,為應對氣候變化和促進經濟轉型提供的契機。通過建設中國能源互聯網實現碳減排目標的系統方案,明確將推進能源開發清潔替代和能源消費電能替代;實現能源生產清潔主導、能源使用電能主導;能源電力發展與碳脫鉤、經濟社會發展與碳排放脫鉤。目前中國大陸尚沒有形成針對雙碳目標的專門立法,但在長期的氣候變化應對工作中,形成一系列政策工具,包括調整產業結構,發展清潔能源,建設總量控制下的碳交易市場,提高能效推進節能,增加森林碳匯等,這些政策措施或可成為將來立法的基礎。日本政府的氣候變化應對政策也為中國大陸應對雙碳目標的政策措施提供借鑒,節能作為日本實現碳中和目標的優選路徑,中國大陸未來在政策基礎之上構建低碳法律體系時,應該將節能制度的優化作為重點。中國大陸在雙碳目標引導下,應促進雙碳目標與《節約能源法》的融合,並順應能源轉型的數位化趨勢與市場化趨勢,補充相關在智慧節能、市場節能等方面的單行法規,優化和豐富節能制度,推動節能制度的完善,促進節能在實現雙碳目標的道路上發揮更大作用。

The target of double carbon which we get carbon peaking in 2030 and carbon neutrality in 2060 drives new kinetic energy for China's sustainable economic development. At present, China has not formed special legislation for the double carbon target, but in the long-term climate change response work, a series of policy tools have been formed, including adjusting industrial structure, developing clean energy, building a carbon trading market under total control, improving energy efficiency, promoting energy conservation, increasing forest carbon sinks, etc. These policy measures may become the basis of future legislation. When China builds a low-carbon legal system based on policies in the future, it should focus on the optimization of energy-saving system. In response to climate change, the Japanese government regards energy conservation as the first policy tool to achieve the goal of double carbon, and attaches importance to keeping pace with the times and constantly improving the energy conservation system. Under the guidance of the double carbon goal, China should promote the integration of the double carbon goal and the Energy Conservation Law, comply with the digital and market trends of energy transformation, supplement the relevant separate laws and regulations on smart energy conservation and market energy conservation, optimize and enrich the energy conservation system, promote the improvement of the energy conservation system, and promote energy conservation to play a greater role in realizing the double carbon goal.
