宜蘭縣議會議事制度及實際運作之研究

摘要

要落實地方自治必須地方政府與地方議會各自發揮功能，為地方居民服務謀福利，彼此雖為監督與被監督的角色，卻也是相互合作的關係。縣議會為縣層級最高民意機關，其組成來自縣各選區依法選出之縣議員，縣議員代表在地民意監督縣政府施政，而施政成果攸關人民福祉，在地方自治上其重要性可見一斑。
宜蘭於1950年10月10日開始設縣，1951年2月14日宜蘭縣議會正式成立，截至目前計選舉19屆，歷屆議員人數達618人。自地方制度法制定公布以來，地方自治法制化時間已22年，時間不算短，惟仍有許多問題尚待釐清及解決，例如中央與地方權限劃分、地方立法權範圍、地方財政不足及自治監督寬嚴不一問題等。本論文旨在研究宜蘭縣議會之議事制度及實際運作，經由研究發現宜蘭縣議會在議事實際運作上產生之難題，包括程序委員會、質詢、預算審議、黨團協商、決算審議、立法權及府會關係等方面。究其原因在於法令上的不完備、重預算輕決算、中央與地方權限爭議，有些則是因議會本身屬合議機關，強調議事自律、黨團協商及府會溝通不良等。
為使宜蘭縣議會議事功能效力提升及民主原則之更佳實踐，本研究針對宜蘭縣議會上開難題提出方法與意見，期望在議事運作上不再發生相同的問題，最後並提出政策上的建議。

To implement local self-governance, local governments and local councils must perform their respective functions to serve and benefit local residents. Although they are supervising and supervised roles, they are also in a cooperative relationship. The county council is the highest public opinion organ at the county level. It is composed of county councilors elected by law from each county constituency. The county councillors represent the local public opinion and supervise the governance of the county government. The results of governance are related to the well-being of the people, and its importance in local autonomy is evident.
Yilan began to set up a county on October 10, 1950, and the Yilan County Council was formally established on February 14, 1951. Up to now, the election has been held for 19 sessions, and the number of councillors has reached 618. Since the promulgation of the Local Government Act, it has been 22 years since the local autonomy was legalized, which is not a short time. However, there are still many issues to be clarified and resolved, such as the division of power between the central and local governments, the scope of local legislative power, the lack of local finance and the issue of leniency and strictness in autonomous supervision, etc. The purpose of this paper is to study the meeting institution and practical realisation of the Yilan County Council. Through research, it is found that the Yilan County Council has difficulties in the practical realisation of its deliberations, including the procedure committee, inquiry, budget review, party group consultation, final account review, legislative power, and government-council relation, etc. The reasons lie in the incompleteness of laws and regulations, emphasis on budget over final account, disputes over the authority between the central and local governments, and some because the council itself is a collegiate body, emphasizing self-discipline in deliberations, negotiation by party groups, and poor communication between the government and the council.
In order to improve the effectiveness of the Yilan County Council's deliberative function and the better practice of democratic principles, this study proposes methods and opinions for the Yilan County Council's difficult problems, hoping that the same problems will not occur in the practical realisation, and finally puts forward policy recommendations.
