行政院獨立機關特性與運作之政經分析

THE NATURE AND OPERATION OF THE INDEPENDENT AGENCIES IN THE EXECUTIVE YUAN

摘要


我國自2004年公布中央行政機關組織基法後,獨立機關開始正式出現在法律上,歷經6年間之運作,金融監督管理委員會及中央銀行等2機關,在面對國際資金流通快速及全球化浪潮,尤其是在經歷金融海嘯及歐債危機等衝擊後,在在印證了其在業務執行上 需具備獨立性,惟在政策制定及政策決定上,則須為一般行政機關組織型態(首長制),以便迅速地做出最符合國家利益之決定。台灣在解除管制、開放市場後,整體通訊傳播產業面臨跨國企業進入市場競爭,全面市場化、民營化與國際化後,國家通訊傳播委員會除了要維持整個市場運作機制,避免國內市場完全由跨國企業或特定集團所掌控外,還要保護國內的產業發展,並對於國內通訊市場,以國家利益為考量,做全觀性的政策規劃引領,是以,國家通訊傳播委員會與金融監督管理委員會相似,即國家通訊傳播委員會的業務性質與政策影響,相當接近於金融監督管理委員會,兩者都有技術匯流的現象,並均較為強調管制的面向。從業務與政策影響之標的團體觀察,中央銀行、金融監督管理委員會及國家通訊傳播委員會等3機關,非如中央選舉委員會或公平交易委員會等2機關,如此特定與明確,前揭3機關具其特殊性,屬須特殊專業之行政機關,因此不必然須定位為獨立機關。

The “independent agency” has become legal term since the promulgation of the Organic Standard Act of the Central Administrative Agencies in 2004. Operations of the Financial Supervisory Commission (the FSC) and the Central Bank of the ROC (Taiwan) (the CBT), under the rapid flow of international fund and the wave of the globalization, and especially the impact of financial tsunami and European debt crisis during the past 6 years, proved that the tasks of the two agencies need to be carried out independently. However the requirement of rapid formation and decision of policies to be in the state’s interests further suggests the structure of the said agencies should be ministerial system. Taiwan’s telecommunications and broadcasting industries faced fierce competition by the transnational corporations after the deregulation and liberalization of relevant markets. Under the circumstances of liberalization, privatization, and internationalization, the National Communications Commission (the NCC) has to maintain market mechanism, prevent the domestic market been dictated by transnational corporations or certain groups, protect the development of domestic industries, and to make pilot projects for domestic communications market in view of national interests. The NCC is therefore somewhat like the FSC in regards to the nature of tasks and policy influence. Both agencies deal with issues arising from technology convergence and emphasize regulation of them. Observations from target groups indicated that, the tasks of the CBT, the FSC, and the NCC (the three agencies), not like those of the Central Election Commission and the Fair Trade Commission, are not specific and clear. Due to their unique nature of operations, the three agencies should be classified as administrative agencies with special expertise and not necessarily designed as independent agencies.
