食品風波下的府際關係：以臺灣廢食用油品事件為例

Intergovernmental Relations in the Enforcement of Food Safety Policy: The Case of Waste Edible Oil in Taiwan

摘要

近年來，臺灣食品安全風波不斷，如塑化劑事件、三聚氰胺毒奶粉事件、混油事件等，尤其是2014年的廢食用油品事件，不僅重創台灣美食王國的形象，亦揭露行政部門於食品安全政策管理上的缺失及不足。然而，過去府際關係及跨域治理之研究大多探討制度面的發展及影響行政部門間建立夥伴關係的障礙，雖實務面的研究成果豐碩，如財政、環保、交通、社會服務等，卻鮮少關注食品安全政策中，行政部門間的互動關係及協調障礙。因食品安全管理牽涉中央至地方相當多政府層級行動者間的互動與協調，故本研究從府際關係的角度來檢視廢食用油品事件發生的原因及處理過程全貌。
本研究依據文獻設計五個分析構面檢視行政部門間的互動模式，分別為權責歸屬及成本衡量、資訊流通、組織文化、資源交換、行政權及檢察權之競合，並透過內容分析法及深度訪談法，針對廢食用油品事件中政府部門間的互動模式，逐一釐清事件的始末、為何產生協調問題、如何導致此危機事件及後續彌補狀況與發展。職是之故，本研究首先逐一檢視官方文獻並繪製事件關係圖，再者以此作為深度訪談的基礎，逐步釐清本研究之問題。訪談期間從2015年8月至2016年4月，共計訪談18位文官、檢察官及專家學者。在發生原因方面，研究結果顯示因過去政府單位間油品管理之權責不清，導致政策執行產生模糊地帶與缺漏，讓不肖廠商有機可趁；在處理過程方面，並非政府相關單位未積極處理，而是過去所累積的缺失一次性爆發，而各政府單位間的資訊不夠流通，導致其處理狀況不佳。因此，本研究建議應釐清行政部門間的權責劃分、促進各單位之間資訊的流通及資源整合，並強化行政和檢調單位之間的合作關係，始能有利於食品安全政策之執行與落實。

In recent years, Food safety issues have drawn the public’s attention. Therefore, this study focuses on the enforcement of food safety management. In particular, it tries to investigate the intergovernmental relations in the implementation of the waste edible oil event in Taiwan and intends to explore how structural variables affect the development of this event.
Document analysis, case study research and in-depth interview are main data collection methods for answering research questions. The findings show that the accountability of the oil management between the governments are unclear in the past years, leading to some errors occurred when implementing policies. On the other hand information isn’t in circulation between the governments, bringing to poor handing of enforcement of food safety management.
Last of all, the suggestion of this study is that trying to figure out the accountability between governments, promoting information and resource flowed and enhancing collaborative between administrative agencies and prosecutors.
