財產保險運用共同保險條款之研究
The Study of Co-insurance Clause Apply to Property Insurance
摘要
共同保險條款於國內書籍少有著墨，目前國內僅少數財產保險中有運用共同保險條款。為積極開發新型態之保險商品，以提升財產保險商品之競爭力。故本研究就共同保險條款之理論基礎著手，重新歸納探討共同保險條款之基本意含，以及共同保險條款對保險費率之影響。透過研究國外財產保險對共同保險條款之背景、目的與使用險種及其運用效果之蒐集與整理，參閱美國、日本、中國大陸與我國現行財產保險對共同保險條款之運用作橫向分析比較，藉以吸取他國經驗，俾使國內財產保險之共同保險條款能符合國際潮流。 本研究針對共同保險條款研擬相關建議事項，作為日後國內財產保險商品能對共同保險條款善加運用之依據，以保險經營者及主管機關日後修正或經營時之參酌，使共同保險條款之運用更能符合被保險人實際需求與保險業者之經營意願。

Co-insurance clause rarely mentioned in the domestic books. Currently, there has seldom been applied the Co-insurance Clause to the property insurance. The purpose is aimed at developing the new type of insurance product and enhancing the competition of property insurance product. In this study focus on fundamental theory of Co-insurance，which discuss in new aspect of basic definition. Moreover, this study mention that Co-insurance how to affects the insurance rates. Through the study of foreign property insurance on the terms of the co-insurance background, purpose and use of insurance and its use of the effect of collection and sorting, horizontal analysis on the usage of Co-insurance Clause refer to the United States, Japan, China and Taiwan's current property insurance. Try to learn from the experiences of foreign country that make the domestic property insurance combine well with international concepts. This study is designed to discuss related suggestion in Co-insurance Clause and to supply domestic insurance product for future reference and also to provide insurance industry with reference. Make sure that Co-insurance usage fit more into the realistic demand of the insured and the will of the insurer.
