從歐盟法制及判決實務探討我國被遺忘權法制建構

摘要

在搜尋引擎及社群媒體蓬勃發展的網路時代，個人資料容易長久被數位記憶予以儲存並流通，為了強化各會員國對個人資料的保護，歐盟於2018年起正式施行個人資料保護規章，其中在該規章第17條明訂被遺忘權規定，同時，歐盟第29條個資保護工作小組針對被遺忘權訂定指導方針與實施準則，作為各會員國予以參考之標準。我國法院亦有涉及被遺忘權的案件，其中法院承認被遺忘權屬於憲法隱私權保障範疇，並涉及民法、個人資料保護法之適用，然而，我國法制是否已有被遺忘權規定，容有討論空間。本文將從被遺忘權的理論及意涵出發，從歐盟法制及案例予以借鏡我國，探討我國法制及實務下被遺忘權的發展脈絡；此外，我國現行法制有關涉及被遺忘權議題，如裁判公開制度下提供各級法院裁判供一般民眾於網路上檢索；全民健康保險研究資料庫基於研究目的所蒐集人民的健保資料，在被遺忘權法制發展下是否有重新檢討之必要，將一併進行探討，進而對我國被遺忘權法制提出建議。

In the Internet era where search engines and social media are booming, personal data is easily stored and circulated in digital memory for a long time. In order to strengthen the protection of personal data by member states of the European Union, European Union has officially implemented The General Data Protection Regulation（GDPR）in 2018, which stipulates the right to be forgotten in Article 17. In addition, The Article 29 Data Protection Working Party has formulated guidelines and implementation for the right to be forgotten as a standard for reference by member states of the European Union. The judgments in Taiwan also have cases involving the right to be forgotten, in which the court recognizes that the right to be forgotten belongs to the right to privacy provided by the Constitution of the Republic of China (Taiwan), and involves the application of Civil Code and Personal Data Protection Act. However, whether the legal system in Taiwan is sufficient to apply the right to be forgotten, should be studied and clarified. This study will start from the theory and the definition of the right to be forgotten, and learn from the development of European regulations and cases in order to explore the development of the right to be forgotten in Taiwan. In addition, this study will discuss legal issues related to the right to be forgotten in Taiwan about the judgments publishing by Law and Regulations Retrieving System of Judicial Yuan and National Health Insurance Research Database relating to data protection. Finally, this study will make legal suggestions on the right to be forgotten in Taiwan.
