探討網路數位化下的銀行監理政策

摘要


本文探討國內銀行業,從傳統銀行的「網路銀行(Internet Banking)」、因應打造我國數位化環境3.0的「數位銀行(Digital Bank)」、因應金融科技應用廣泛的「純網路銀行(Internet-only Bank)」。此三種型態係銀行業金融交易服務模式的通路,在發展期間的過程因科技的進步是循序漸進的演化及進化的,就主管機關推動的相關的對應政策、法規、策略、面向、以及辦法或規範等等項目下,因政策下修訂法規進行探討。以及探討述之三種型態的網路數位化金融交易服務通路的不同之處。 結論依據本文觀察到的資料我國「純網路銀行(Internet-only Bank)」在監理法令框架部份,主要延用以現有的「網路銀行(Internet Banking)」和「數位銀行(Digital Bank)」之法規條款加以研議後修訂發布之,並没有再訂定專門的法令規範或者是核發特殊的執照。這部份借鏡 「國外目前全球主要國家如.美國、英國、歐盟、日本、中國大陸,在「純網路銀行 (Internet-only Bank)」監理的法律框架方面,以安全與穩健方面作為監理為主要原則。」 本文針對網絡數位化下我國銀行業監理政策提出以下建議: (1)政府機關執行推動「監理科技(SupTech)」。 (2)銀行業內推動「法遵科技(RegTech)。 (3)銀行業內因應數位科技時代應行調整企業內之組織架構。 (4)加強因數位科技時代對個資之保護。 期許銀行業在政府協助下發揮功能、及兼顧金融監理與金融服務業平衡的發展,邁向數位台灣及放眼全球之步調,持續成長。 關鍵字:網路銀行、數位銀行、純網路銀行、監理科技、法遵科技

This article discusses the domestic banking industry, starting from traditional banks' "Internet Banking", "Digital Bank" in response to the creation of my country's digital environment 3.0, and "Internet-only Bank" in response to the widespread application of financial technology. These three types are the channels of the banking financial transaction service model. Due to technological progress during the development process, the evolution has been gradual. The corresponding policies, regulations, strategies, orientations, and methods were promoted by competent authorities. We will discuss the revision of laws and regulations under the policy, and the differences between the three types of online digital financial transaction service channels. Conclusion based on the data observed in this article, my country’s "Internet-only Bank" is mainly extended to the existing "Internet Banking" and "Digital Bank" regulations in the framework of supervision laws and regulations without the formulation of special laws and regulations or issuance of special licenses. This part borrows from "Foreign major countries in the world, such as the United States, the United Kingdom, the European Union, Japan, and Mainland China. In terms of the legal framework for the supervision of "Internet-only Bank" safety and stability are the supervision The main principle." This article proposes the following recommendations for my country's banking supervision policies under the digital network: (1) Government agencies implement and promote "Supervisory Technology" (2) The banking industry promotes " Regulatory Technology ". (3) The banking industry should adjust the organizational structure of the enterprise in response to the era of digital technology. (4) Strengthen the protection of personal assets in the era of digital technology. It is hoped that the banking industry will perform its functions with the assistance of the government and take into account the balanced development of financial supervision and financial services.
