犯罪,是人類歷史上從未止歇的現象,無論何時何地,只要有人的地方就有犯罪,對於現代的國家來說,抗制犯罪、維護治安,是執政者的基本職責。而刑罰規範,是國家機器抗制犯罪之重要憑藉,它既是國家制定犯罪抗制對策及懲罰犯罪者之依據,更關乎一國家對於犯罪的定義及處理方式。從歷史的演進來看,犯罪不僅持續存在,更日益猖獗,迫使國家機器必須一再調整刑罰規範和抗制犯罪的對策。 刑罰規範和犯罪皆是歷史的產物,而刑罰規範的更迭,整體而言,是社會環境變遷的產物,在本研究中,筆者將以歷史縱深的視野和橫向比較的角度,探討台灣的國家機器在何種結構條件發生時,會改變刑罰規範中犯罪的定義以及修改刑罰規範或變更施予刑罰的手段,藉以理解在抗制犯罪場域中,國家與社會之互動關係,並深究刑罰規範變遷背後的實質內涵。
Crime is the eternal phenomenon in human history. Modern states is under an obligation to combat crime.However, modern states can't combat crime without criminal norms. Criminal norms not only provide the government with legal basis to crack down on crime, but also decide the definition and punishment of crime. What's more, because crime changes constantly and doesn't disappear, the government needs to modify criminal norms all the time. The change of criminal norms are produced from the social environment.This study explores on what conditions did state apparatus make an amendment to criminal norms in Taiwan. The purpose of this study is to understand State-Society Relationship in the area of fighting crime and further discuss the meaning of changes in criminal norms.
