論我國對於電信產業之非對稱管制：以無線寬頻接取業務為中心

Asymmetric Regulation in Telecommunications Industry in Taiwan: A Case Study of the Regulations on Wireless Broadband Access Services

摘要

本文嘗試探討在數位匯流趨勢下，我國非對稱管制於電信產業的發展影響與因應對策。本研究首先介紹非對稱管制之意義與其在電信產業影響之重要性，並說明其基礎理論及解析實施手段的必要性。其後整理我國電信主管機關對於電信產業非對稱管制從昔至今的管制態樣，歸納各電信法規中蘊含的非對稱管制議題，並針對其重要性及影響進行綜合分析。其後之比較法研究，透過介紹美國、英國的電信管制政策的歷程，並各針對該國管制重要市場主導者AT&T 與BT 的管制手段、經驗與成效與相關法規範。
歸結上述研究成果，並透過此一新興電信產業案例研究：無線寬頻接取業務管理規則進行檢視。參考英、美發展經驗，嘗試建立一套管制架構之方法論，介紹我國無線寬頻接取業務的現況，並分類成「內部非對稱管制」與「外部非對稱管制」，應用其前述之管制架構，探討法規造成與既有電信市場的競爭關係影響，並提出簡要之意見，以驗證非對稱管制手段於我國的具體實踐和後續建議。

Under digital convergence in the telecommunications, the meaning of asymmetric regulation might be different in this day. This study explores asymmetric regulation with documental researches and comparative analysis, especially the regulation experiences of AT&T and BT. Finally, it also infers that there would be some important issues related to asymmetric regulation from laws and regulations.
On the basis of comparative analysis, this study concerned “Regulations on Wireless Broadband Access Services” and built a methodology regarding regulations to divide into two groups. To the end, this study reconfirms the result of asymmetric regulation and proposes few opinions and suggestion.
