從桃園航空城案看我國聽證制度的設計與實踐

摘要

近年來發生許多引起大眾注目的土地徵收有關事件，例如中科四期、苗栗大埔案、台南鐵路東移案以及本文這次想討論到桃園航空城案等等，顯示出了我國在土地徵收制度設計上仍有許多瑕疵與問題，雖然政府通常進行徵收之目的是為了國家公共事業之需要甚至是為了促進區域之發展與進步，但即使如此亦不應忽視在開發過程中土地被徵收人民之權益與意見，為了能真正了解到人民之意見與釐清土地進行徵收將引發之爭議，人民在知道自己土地將被徵收時，具有能夠讓民眾發聲與表示意見之管道相當重要，而該如何設計適當又能真正發揮功用之發聲制度即為其首要任務。
綜觀我國現行法規制度來看，最適合讓人民能夠發聲表達意見之方式即是行政程序法中所規定的聽證制度，本文將從實際的案例，桃園航空城案做引導來分析我國現行聽證制度設計之情形是否能夠有效保障到民眾之權益，本案因符合土地徵收條第十條第三項之規定，其所徵收範圍內之土地包括有特定農業區，依法應舉辦聽證，其舉辦情形與舉辦後是否真有符合民眾之期待即為本文將討論之重點，包括官方所設計之聽證舉辦方式有何瑕疵與應以何種方式改善等等。
除實際執行情形外，本文也會對我國現行土地徵收制度與民眾參與制度做介紹，從徵收前，上位之區域計畫、都市計畫開始到土地徵收，民眾參與則以聽證為首，另外還包括了公聽會、公開展覽、說明會與陳述意見等等之規定，希望藉由了解我國此類相關法規以及對於實際辦理之情形做研究，進而幫助現行民眾參與機制規定之改善，使日後土地被徵收人民之權益能夠更加的完備與完善。

There have been many controversial cases of eminent domain recently in Taiwan, especially the case of Taoyuan Aerotropolis, which be known as the case of eminent domain in the history of Taiwan.It shows there are still lots of flaws and problem on the design of eminent domain system. To protect the people whose land be taken and ensure they get opportunity to elaborate their thought. To do that find out and use the proper way is the very first priority task.
Official hearing system is the most suitable way for people to descript their thought in Taiwan for now. This essay will analyze that how did government hold the hearing on the case of Taoyuan Aerotropolis. To understand that can the current hearing system protect the people whose land be taken from the government. And will introduce regional planning law, urban planning law, and eminent domain law, public participation which include the way of hearing, public hearings, public exhibitions, briefings and statements. Hoping to understand the relevant laws and regulations as well as the actual management of the situation to do research, and then help the current law of public participation improve. Try to make the law that protects people’s rights and interests can be complete and perfect.
