不動產登記制度中註記登記法律性質及救濟方式-以具限制性質之註記為例

摘要


不動產登記的目的為確定權屬狀態及維護交易安全。將法定登記事項以外之特定事項登載於不動產登記簿之標示部、所有權部、他項權利部之其他登記事項欄內,稱之為註記登記,不論以註記方式登載或以註記之原因登載之註記登記,將其區分為獨立存在之註記及特定土地登記內容一部之註記。註記之法律性質究是行政處分或事實行為,應依個案判斷認定,行政法院認為註記非土地法第37條所指之土地登記,因此不生不動產取得、設定、喪失及變更之效力,不論獨立登記之註記或特定土地登記內容一部之註記均有具限制性的註記,其法律效果具有公示效力,亦有對抗第三人效力;若該註記登記之存在,影響土地所有權之圓滿狀態,則依行政訴訟法第8條第1項規定提起一般給付訴訟,請求行政機關作成行政處分以外之其他非財產上給付,以排除該侵害行為。本研究透過具限制性的註記實務案例及學者的論述分析註記登記之法律性質及救濟方式,藉以體現憲法第15條保障人民之財產權。同時建議未來對於不動產登記法的訂定,應增加註記登記之專章,並統一登記方式及提供註記登記的標準,以減少不動產的交易糾紛。

The purpose of real estate registration is to determine the ownership status and maintain transaction security. The legal nature of the notes is an administrative sanction or factual act, which shall be determined depend on type of the case. The administrative court considers that the notes do not refer to the land registration referred to in article 37 of the land law, and therefore do not give effect to the acquisition, creation, loss or alteration of immovable property. whether independent registered notes or specific land registration part of note have restrictive notes, that legal effect is counter force and open to the public for examination. If the note registration affects the completeness of the land ownership, use general payment action shall be filed pursuant to article 8, paragraph 1, of the administrative procedure law to relief. This research through the restrictive note practice case and scholars discussion, to analysis legal nature and relief way, refer to the constitution article 15 to ensure the property rights of the people. at the same time, it is suggested to add special chapter for registration of notes and also to define unify method of registration in the new real estate registration law.
