論專利連結與資料保護對我國醫藥產業之影響

The Impact of Patent Linkage and Data Protection on Pharmaceutical Industry in Taiwan

摘要

美國與韓國自由貿易協定(FTA)正式生效後，我國積極重啟台美貿易暨投資架構協定（TIFA）談判，期望進而爭取加入跨太平洋夥伴協定(TPP）與簽定台美自由貿易協定。在我國與美國談判過程中，美國勢必會要求我國開放部分項目或改變我國原有制度。參考2007年到2013年之（台灣白皮書），在製藥產業的部分，關於智慧財產權保護之項目，主要圍繞在專利連結制度和資料保護兩種制度。
本論文將研究美國以及其他各國於專利連結制度和資料保護的規定，並對於我國專利連結制度與資料保護的相關規定進行討論與建議，期待能成為未來相關機關的參考資料。

Since the United States-Korea Free Trade Agreement entered into force, the policy in Taiwan turns toward to restart Taiwan-U.S. Trade and Investment Framework Agreement (TIFA) and looks forward to signing free trade agreement (FTA) with the US and participating the Trans-Pacific Partnership (TPP). During the negotiation between Taiwan and the United States, it can not be avoided that the United States requests Taiwan to open up some policy or revise currently regulation.
Regarding to the pharmaceutical industry part in the White Paper within 2007 to 2013, the topic focused on the issue of the patent linkage and data protection in intellectual property rights.
This thesis will study the patent linkage and data protection in the United States and other countries, and also discuss and give recommendations to the relevant legislations and regulations of the patent linkage and data protection in Taiwan.
