越南人士偷渡來台使用船筏及航行設備之研究

摘要

臺灣近幾年來，因開放越南外籍新娘及大量引進越南籍外勞，致國內各行業消費階層型態丕變，國內資方對越南籍外勞較為偏好，價廉受用度高，致市場需求度增溫，越南籍人士紛紛透過各種管道，仿效先前中國人士偷渡模式偷渡來台。以往我國偷渡案例的研究幾乎以中國偷渡案件為研究對象居多，對於越南偷渡案件較少進行研究。本研究收集自2010 年至2011 年海巡署查獲越南偷渡案例共9 例，以船舶型式、航行設備、人員操縱、時間及上岸地點資料加以分析比對並建構越南偷渡犯自越南經中國到台灣之間可能偷渡路徑。最後輔以海巡署資料分析越南偷渡人士自中國出發及抵達台灣時之海象特性並與中國偷渡案例作比較。結果發現自2007 年開始每年都有發生越南偷渡案例，其中又以每年的第二季、四至六月間最多，時段以夜間凌晨0時至4 時最多。而偷渡上岸地點以台灣南部縣市（台南、高雄及屏東）最多。就可能發生越南偷渡路徑，在考量偷渡成本下越南偷渡案自廣東出發偷渡來台比例明顯高於由福建出發之比例。就船舶型式、航行設備、人員操縱與海象條件，不論自中國偷渡出發時或是偷渡抵達台灣時，當船舶型式過小、航行設備簡陋、人員操縱不良與海象條件差時，發生偷渡成功上岸案例就愈少。為防範此越南偷渡案件，執法機關除了研擬、重視勤務部署及加強查緝外，也期望台灣與中國、越南間能在現有共同打擊犯罪協議基礎下對於防範及查緝越南偷渡案件能更加重視。

Taiwan, in recent years, consumer startums patterns changed radically by reaseon of opening up for forien brides and introducing large amount of foreign laborers from Vietnam.Domestic employers favored foreign laborers from Vietnam.Low salaries and high benefit increases market demand.Thus Vietnam nationalities stow away through various kind ways one after another by imitating China(PRC) nationalitys' method previously.Formerly of our nation, cases study of stow away were mostly object of chinese stowaway cases,but less with Vietnam cases.This research gathered nine cases from CGA(Coast Guard Administration) investigated and captured between 2010 and 2011 by analyzing and comparing with type of ships, navigational equipments, manipulation, times and location ashore, to construct passible routes for Vietnamese stow away through China to Taiwan.
Lastly supplemented by analyzing the characteristic of sea condition data from CGA during Vietnam stowaways proceed from China and arrived at Taiwan and compared with cases of China's stowaways.Result shows the stowaways from Vietnam is occured every year since 2007.In second season - from April to Jun - are the most cases therein.The times majority would during before dawn about zero to four.And ashores location oftenly were south counties (Tainan, Kaohsiung and Pingtung).On the possiblly route of Vietnamese stowaway, and considered with cost of stowaway, the ratio of departure from Guangdong obviously higher than Fujian.
On the type of ships, navigational equipments, manipulation and sea conditions, it's not matter whenever stowaways departured from China or arrived at Taiwan, as long as ships type are too small, poor navigation equipments, badly manipulation, or with horrible sea states, there is less successful ashored of stowaways.
To take precautions of these illegal emigration,the law enforcement not only formulates, pay attention to deploy tasks and enhances investigation and seizing, but also expect of there will attaches more importance to prevent, investigate and seizes cases of Vietnam stowaways upon the foundation of availabled Joint agreement to fight crime between Taiwan, Vietnam and China.
