導入規劃專業參與都市計畫審議機制之研究－申護制在高雄市的試行經驗之評估

台灣都市規劃係由政府主導，並在公共利益為支撐之主軸下，進行財產使用權之界定。而為強化民眾參與，各級都市計畫委員會准予與案情有關之公民或團體代表列席說明並應詢。然大部分民眾缺乏都市規劃之專業知識，無法就公共利益加以論述，而僅能就其私人權益說明，常難獲擔心圖利之嫌的委員認同，致常造成民怨及執行時之抗爭。在此情形下，為強化民眾列席之有效說明與溝通，高雄市都市計畫委員會試行都市計畫申護制，引入都市計畫等專業技師協助陳情人申護。試行成果顯示，導入專業參與都市計畫審議作業之申護作業，可強化審議資訊之不足及其對稱性，能降低審議之交易成本，使審議作業不論是在審議品質或是減少審議時間上均能獲得提升。

The right of property use in the urban planning in Taiwan is validated under the leading of the government and the concern of public interests. To reinforce citizens' participation, all levels of urban planning committees allow general citizens or association representatives who are related to specific cases to attend the meeting to explain and to be inquired. Nevertheless, in lack of professional knowledge of urban planning, most citizens tend to experience difficulties stating their opinions in the discourse of public interests rather than in the favor of their personal rights. Such tendencies often lead to the committee's disapproval because of the suspicion that citizens' opinions are only made for personal benefits, and the disapproval usually results in civil resentment and protests against the execution of certain urban planning cases. In order to enhance efficiencies of citizens' statement and communication, the Urban Planning Committee of Kaohsiung City Government tried Advocacy Procedure in Urban Planning Reviews by introducing professional urban planning engineers to assist citizens as advocators during Urban Planning Reviews. The results show that by introducing professional participation, the transaction costs in Urban Planning Reviews are positively decreased. Moreover, the reviewing time is efficiently reduced, and the reviewing quality are improved.
