摘要

醫療糾紛是困擾醫療專業人員的主要議題之一，雖然近年來已有許多相關的倡議，然而卻缺乏一個整體性爭議處理架構。在美國，醫療糾紛同樣也是個困擾醫療專業人員的主要議題，從1970年代以來，美國共經歷過三波醫療糾紛危機，同時也累積了許多經驗。本文將以哈佛經驗為例，介紹美國是如何透過前瞻性架構來處理醫療糾紛。文末，也將對台灣現有制度提出反思。

Medical dispute is one of major issues which disturb medical professional staffs. Although there are many initiatives existed, a holistic medical dispute resolution system is needed. Medical dispute in the United States is a major concern as well. Experience was accumulated in three waves of medical dispute crisis since 1970s. In this paper, we selected the Harvard experience as an example to demonstrate how they dealt with medical dispute through a prospective framework. At the end, this paper also provides reflections on Taiwan medical dispute resolution system.
