國際規範與我國對原住民族傳統文化日益重視,且在現行智慧財產相關法規範能有效保障下,行政院通過「原住民族傳統智慧創作保護條例」草案,試圖透過法以落實憲法增修條文第十條第十一項以及維護文化多樣性、原住民族權益之保護,但因國內相關法律概念未臻成熟,原住民族傳統智慧創作保護條例草案之實效性仍多有疑義,故而,本文從國際體例與我國憲政、社會共識的凝聚方面開始,探討原住民族傳統智慧創作保護條例草案之立法背景,列舉條文中重要或有爭議之部分,以及智慧財產權理論之侷限性與適用性,並於結論時替立法之闕漏,構想解決的方法和建議。
With international principles and our state putting more and more emphasis on the indigenous people's traditional culture, which, however, is not under the effective protection of the present intellectual property right law, Executive Yuan passed the draft of ”Act on Protection of Indigenous Peoples traditional Intellectual Creations”. By the Act, Executive Yuan wants fulfill the 10 ”article, 11” paragraph of the Amendment of the Constitution and preserve the cultural diversity and minority rights However, because the immature state's relative law and many uncertainties exists in the effectiveness of the draft of ”Act on Protection of Indigenous Peoples traditional Intellectual Creations”, this article starts from the consensus of international principle, our state's constitutionalism and social common understanding, and study the background of the draft of ”Act on Protection of Indigenous Peoples traditional Intellectual Creation”. It also lists the important and disputative parts, limitations and applications of the intellectual property rights theory. In the end of the article, the author gives the ideas and suggestions for resolving flaws of this Act.
