摘要

近幾年來政府每每在「天然災害」威脅下，特別重視環境與國土保安之落實，其間各種「限制發展區」之劃設亦接踵而至。然由於限制發展區之劃設涉及區內土地所有權人之權益至鉅，民眾抗爭爰層出不窮，導致政府施政裹足不前，連帶影響環境保護政策之執行效力，以及削弱相關法律之應有效益。本文有鑑於此，擬以「法制經濟分析法」(Economic Analysis to the Law)為研究主軸，就土地使用限制與損失之相關議題加以探討。在文章結構安排上，首先評介土地使用限制之相關理論與文獻，藉以作為本文之論述基礎，繼之，分別從公、私經濟之觀點研析土地使用限制與損失補償間之關聯性，最後本文試圖以相關之大法官會議解釋文為對象，從本文分析角度與心得提出淺見，以供主管機關研析法律之參考。

Recently, the Taiwan area is under the stronger pressure from the natural disaster. The Government, therefore, tries to solve this issue based on the environmental conservation policy and related measures. Meanwhile, the establishment of the ”land use restriction zone” is become the most important policy (instrument). However, few researchers have focused their attention on examining the importance of the economic-based approach to the legal institution surrounding this issue. In addition, the enforcement of establishment of the ”land use restriction zone” has much restriction on the private land-use rights. This paper is therefore to analyze related legal institution based on the approach of the ”Economic Analysis”. The structure of this paper can be described as follows: first, the ”land use restriction” and the related literatures will be reviewed, second, some issues will be analyzed on the ”public' and ”private” viewpoints to the land ownership. At last, some important suggestions will be proposed.
