論美國同性戀與平等保護－兼論我國同性戀人權保障之發展

摘要

同性戀人權從最早之爭取平等保護，到近來爭取婚姻、訴訟及繼承等權利。同性戀者爭取人權運動，是一段艱辛血淚奮鬥史。為落實人權保障及尊重同性戀權益，法務部完成「人權保障基本法」草案，草案明定同性戀男女也可以依法組成家庭及收養子女，這項草案已由法務部報請行政院審查中，政院審查通過即可送請立法院審議，一旦完成立法，我國之人權保障工作將進入新的里程碑。我國藉由「人權保障基本法」之制定，展現其關注人權保障之決心，以提昇台灣人權形象所做之努力，誠值肯定與讚許。

From the early stage the homosexual called for the equality of protection to recently they fought for their rights in marriage, lawsuit and inherit, etc., it is really a heartrending history for homosexual to strive for their human rights. In order to ensure homosexual's rights and put human rights protection into effect, the Ministry of Justice had drafted ”The basic law of human rights protection”. The draft prescribed that homosexual could form a family and adopt children. This draft was under discussion in the Executive Yuan. If being approved, the draft will be reviewed by the Legislative Yuan. Once the law is enacted, it symbolizes that our country will mounted a new mile stone in human rights protection. The effort our country did in the enactment of the a/m law in order to put our determination in human rights protection into practice and to promote Taiwan's image in human rights protection is really worth being praised and encouraged.
