少年司法處遇場域中的臨床論述與實務呈現-以一妨害性自主少年個案爲例

摘要


本文之撰寫,係筆者以多年在少年司法處遇場域之實務經驗爲論述背景,針對臨床實務之內涵(包括臨床之定義、工作方法、臨床工作者之實務能力等)、審前調查與臨床實務之關聯(包括審前調查之目的、內容)等議題,進行另一種有別於傳統精神病理視框的主觀詮釋。文中,筆者並以自身對臨床實務之論述爲基礎,呈現一妨害性自主少年於觀察期問之個案處遇過程,作爲實踐自身臨床論述之經驗分亨。從個案處遇的過程中發現,藉由增強個案的能力感和自信心、促進親子間想法與情感的交流以改善彼此之互動關係及透過性教育的實施以導正個案的性態度與性價值觀,對於提升妨害性自主少年個案之再犯預防效果是有幫助的。

The paper is based on the author's years of practical experience in the institution of juvenile justice. Here the content of clinical practice is treated differently from the view of traditional psychiatry. Also, the connection between pre-sentence and clinical practice is discussed. Finally, a case study of juvenile delinquent made offense against sexual independent is used to describe the author’s experience of clinical practice.
