摘要

恐怖主義活動是國際安全保障環境中新的威脅來源，在「九一一事件」發生之後，日本迅速的成立「反恐特別措施法」，對美國的反恐戰爭提供後勤支援，建立了危機管理的合作機制，也替日本的防衛政策注入了新的要素。本文主要探討三個主題，首先是日本為何能夠迅速成立「反恐特別措施法」，其次是已經有了自衛隊海外活動的法源，為何還要新成立「反恐特別措施法」，最後討論「反恐特別措施法」引起的爭論點。

Terrorism is now posing a new threat to international security. After the 9-11 disaster in America, the Japanese government immediately established 'Anti-terrorism special measure bill' to back up the American anti-terrorism wars. This special bill not only set up a cooperative mechanism of crisis management, but added new elements to the Japanese Defense Policy as well.This paper deals with three main issues. The first issue is why Japanese government is capable of enacting and passing this special bill so promptly, and next, why 'the bill' is urgent since the overseas military activities by Japanese Self Defense Forces are under law. The last issue will discuss the arguments arising from this special bill.
