警察職權行使法問題研析

警察為國家合法的執法力量，執法能力的高低酌實影響我國家的形象，警察執行任何一項的勤務手段皆須依法有據，以符合法治國依法行政的原則。警察職權行使法（以下簡稱本法）作為我國警察每日勤務實施中皆須行使的基本作用法，在立法之初故有其之時空背景，在經過十數年的運作之後已然有一些問題產生，使得警察在實務的運作上常有執法能量不足的遺憾，甚至會有巧婦難為無米之炊，本文研究的出發點是以實務所發生的案例作為本法的問題提出，並將本法的立法背景予以說明，從而以整部法律的立法體例作為巨觀的角度來說明本法的立法例上有何不妥之處，並以各別法條立法上的缺失作為微觀的角度對個別法條提出立法上的疑問，文末並說明立法上的修正方向作為結論，期盼能對本法的未來修法上提供一些方向。

The Police represent the legal enforcement of a country, and the ability of law enforcement affects the image of our country severely. Any executions of the police have to follow the law to in accordance with the legal principals of a country that is governed by law. Police Power Exercise Act (PPEA.), is as a foundational law, which is used by our country's police officers for their daily tasks. In the very beginning, the legislation of PPEA was come up with its needed reasons and the so called time background; however, after decades, the law of PPEA has obviously shown and appeared its insufficiencies and problems on police's task executions. The purpose of this study is to point out the problems of PPEA from the real cases, and to explain the legislative background of PPEA, then to adopt the entire legislation of PPAE as macro-perspectives to exam and demonstrate the inadequate points on its legislation, moreover, to adopt the deficiency of individual article as micro-perspectives to question the legislation of individual article. The conclusion of this study is to demonstrate the adjustments of legislation and to provide the legislative directions for the upcoming lawmakings.
