差異與肯認:初探多元民主國家原住民族法制建構之政治哲學基礎

Differences and Recognitions: The Political Philosophy of the Legal Construction of Indigenous Rights in the Multicultural Democracy

摘要


國家針對原住民族所施行的積極性差別待遇,始終必須面對來自各方的質疑,舉凡原住民族傳統慣習應否納入現行國家法律體系,和原住民族成員所享特殊政治、經濟、與社會權利,是否違反憲法平等原則等,皆存在一定程度的論證負擔。本文因此擬就前述權利的正當性問題,進行政治哲學的初步反思。本文的最終結論是,國家基於實踐憲法所明定的多元文化國目標、矯正歷史不正義、和肯認文化平等的價值思維,進而針對原住民族發展展開各項所需的扶持作為,不僅合乎我國憲法的國家目標規定,也呼應當代多元文化主義的倫理價值觀點。

In the discussion of contemporary political thoughts, it is always controversial, whether the indigenous peoples possess the legitimacy to enjoy some special rights in the state. Regardless of the questions - whether the traditional customary practice of indigenous peoples should be included in the existing national legal system, or does it violate the constitutional principle of equality if the members of indigenous peoples enjoy some special rights in the political, economic and social lives of the state; both reveal a certain degree of the burden of justification to these questions. This paper therefore intends to explore the issue of the legitimacy of such rights and comes to the following conclusion: In order to implement the constitutional goal of being a multicultural state, to restore the historical injustice of the state and to recognize the constitutional value of the culture equality, the initiatives promoted by the state are therefore not only in accordance with the basic spirit of our constitution, but also comply with the moral point of view of the contemporary political philosophy of multiculturalism.
