公務人員行政中立與案例分析之研究

摘要


我國為因應民主政治發展之需要,創造政黨良性競爭之環境,健全文官系統,確保公務人員行政中立之價值得以落實,業於2009年6月10日公布實施公務人員行政中立法。 檢討國內學術文獻,多針對公務人員行政中立之法制建構、憲法上言論自由之限制、各民主國家行政中立之經驗或地方政府基層公務人員行政中立之現況等,作為論述與研究之主軸,惟仍缺少一針對案例分析較全面性的研究,實有重新檢視之必要。 公務人員乃係國家治理之根本與基礎,背負著人民之期待與執行國家任務之使命,執行與貫徹各項政府決策及行政作業。然而,該如何在與公務人員行政中立法進行配套之基礎上,促使行政中立之精神與要求落實於公務人員實際的行政活動之中。另一方面,也必須瞭解到公務人員在行政運作的第一線面對行政中立要如何面面俱到,如何瞭解到違反行政中立之行為態樣,即是未來推動行政中立與建立標竿制度之關鍵。因此,本文擬針對我國公務人員之審判實務現況與違反行政中立之案例進行分析,期望透過案例分析之結果,進一步瞭解影響公務人員行政中立之政治因素與界線。

In response to the demands of the development of democratic politics, Taiwan has created an environment for the benign competition of political parties, improved the civil official system, and ensured the implementation of the value of administrative neutrality of civil servants. On June 10, 2009, the government has acted the implementation of the Public Servants Administrative Neutrality Act. Reviewing domestically academic literature, most articles focused on discuss and research the legal system of administrative neutrality of civil servants, the limitation on speech of freedom in the Constitution, the administrative neutrality of democratic countries, and the current status of administrative neutrality of local basic-level government officials, these dissertations lack of a comprehensive study of case studies, hence it is necessary for re-examination and this dissertation aimed to review and discuss the core conceptions of administrative neutrality of Public Servants. Civil servants are the foundation and foundation of state governance, carrying on the people's expectations and fulfilling the mission of the state, and implementing various government decisions and administrative operations. However, on the basis of supporting the legislation in the administration of civil servants, the spirit and requirements of administrative neutrality can be implemented in the actual administrative activities of civil servants. On the other hand, it is also necessary to understand the first line public officials how to react when they faced with administrative neutrality of administrative operations. And understand the violation of administrative neutrality is the key point to promote administrative neutrality and establish a standard system in the future. Therefore, this paper intends to analyze the current situation of civil servants in Taiwan and the case of violating administrative neutrality. It is hoped that based on the results of the case analysis, we will further understand the political factors and boundaries which affecting the administrative neutrality of civil servants.
