地方政府對於所管地區之發展及治理與都市計畫有著密不可分之關係,故都市計畫常成為地方政府善用的都市治理工具,其可表現出地方政府之權力自主性。而都市計畫是一個持續性、動態性的過程,個案變更更是對於土地使用的調節行為,可以觀察地方政府在制度授權下的權力自主行為。本文從地方政府在獲得法令授權得自行認定辦理都市計畫個案變更之要件後,以其實際辦理都市計畫個案變更之情況觀察與其權力自主的關係及演變情形。 本文從地方自治相關文獻,說明地方政府於地方自治中的角色,從制度面說明目前地方政府的之權力主張及限制(監督),繼以近來興起之地方治理概念,說明地方政府在對於施行地方政策時,與上級機關、地方民眾及團體之互動過程及其應持之態度與方法,再從土地使用變更之相關文獻研究,討論地方政府辦理都市計畫個案變更之政策意涵與地方自治及地方治理之關係。 經以桃園縣之案例分析結果顯示,其權力自主之演變情形為:在法令修正授權後之辦理案件數量增加、類型多元化、地方政府角色多變、地方層級都委會制度功能弱化、地方政策施行仍受中央之監督與協助。本文建議在地方政府尚未準備充分迎接權力的授予時,應仍受中央之監督。而地方層級的都委會組成應有所改變以彰顯其制度功能及地方政府應朝向地方治理的概念思考其地方權力自主之行為。
The local government often use urban plan as a tool to manage the region’s developments and shows its governance and autonomy. The case alteration of urban plan can show the local government’s autonomy. This research aim at the laws authorize the local government transacting the case alteration of urban plan, to understand the local government’s autonomy and the becoming. This reserach is from the relevant documents of local autonomy, local governance and the alteration of land use, to discuss that the local government transacting the case alteration of urban plan. Shown with the case analysis result of Taoyuan County, its development situation with autonomy is: Handling the quantity of case to increase after the decree is revised and authorizes, type pluralism, local government role changeable, local level urban planning commission system functions are weakened, the local policy implements and still receives the supervision and assistance of central authorities to entrust. This research proposes when the local government has not made adequate preparation to meet power yet to award, should still receive the supervision of the central authorities, the local level urban planning commission should change in order to reflect their system function and local government should move towards concept of local governance to think their behavior.
