捷運工程界面風險探討

摘要


捷運工程規模龐大、複雜性高、工作界面亦多,且其工程常涉及土木、建築、水環與機電等相關領域,因此不同於一般營建工程以單一標為介面主體,而又以土建工程與機電系統工程標之分標模式進行發包作業,各作業由不同專業廠商負責製造、安裝及測試,業主則另與承包商訂定合約關係,然各承包商間分別對業主履行合約之義務,且彼此間無任何合約關係,而捷運工程界面眾多且環環相扣,因此於分工與分標模式下易產生介面之問題,並衍生後續之糾紛與爭議,而業主與承包商更恐因介面未知風險而受至影響。 因此本研究首要針對機電系統及土建工程契約與國際工程契約及FIDIC Silver Book進行比對,藉以檢視契約風險分配關係之合理性;其次利用文獻回顧與深度專家訪談法,彙整捷運工程介面之風險因素,並針對實際參與之專案人員進行問卷調查,利用因素分析法得出其界面風險因子,並彙整業主、土建與機電承包商所可能承擔之風險因素,最後以臺灣桃園國際機場聯外捷運系統工程為案例,進行探討與驗證,進而研擬其因應對策。期研究成果能供工程主辦機關與承包商參考,提供更佳的判斷作為參考,以提供更佳的判斷,並降低工程爭議使工程得以順利的進行。

MRT is a huge and complicated project with multi-interface fields. It contains interrelated fields such as civil engineering, architecture, water supply, environment, electro-mechanical systems. That is why MRT is quite different from normal engineering project which has construction contract as the leading interface contractor. Client subcontracted MRT to several civil EPC contractors and one electro-mechanical EPC contractor. Each contractor is responsible for the manufacturing, installation, construction, test and commissioning within its scope according to the contact with Client. There are no responsibility and contract between different EPCs. And different fields or systems are mutual-related and interwoven. The mold of split of work and contracting causes interfacing problems and conflicts and arguments to both EPC contracts and Client. Both EPC contractors and Client are affected by the unknown interface risks. This study investigates the rationality of contract risk portion for the two present main contractors, electro-mechanical EPC and civil EPCs by comparing the contracts of electro-mechanical EPC and civil EPCs with international contracts and FIDIC Silver Book. A preliminary list of MRT interface risk facts was gathered by the method of reviewing academic documents and reports and vast interviewing experts, then, the final MRT risk facts of MRT interfacing were sieved from the list by the fact analysis method of polling from experts who attend the MRT projects. Finally, the lists for the risk factors of Client, the risk factors of electro-mechanical contractor and the risk factors civil contractors were summarized separately from the final MRT risk factors by consulting from Client, electro-mechanical contractor and civil contractors. All those facts are verified by case study of TTY International Airport Access MRT project, also the countermeasures are considered. The result of study will be presented to MRT Authority and Contractors for their reference to reduce the conflicts which might affect the schedule of project construction.
