我國勞動派遣制度問題之研究

摘要


摘 要 本論文之研究題目為「我國勞動派遣制度問題之研究」,主要就目前勞動派遣制度在我國實施現況,藉由實務訪談,探究目前實務上所面臨的問題,參考相關之文獻、書籍、論文及研究報告,並比較外國之立法概況,加以彙整,期望藉研究之過程,對於日趨受到重視之勞動派遣制度能有正確的認知。勞動派遣制度有別於傳統勞動關係,是一種新的人力任用模式,其間牽涉了派遣雇主、派遣勞工與要派人三方之權利義務,派遣雇主並未親自指揮監督派遣勞工並受領勞務,而真正指揮監督派遣勞工之要派人與提供勞務之派遣勞工之間卻無契約關係,此種情形造成在法律上需課以雇主責任時的困難,故釐清其間之權利義務關係成為重要課題。 本論文研究重點分為三部分,第一部分,在探討勞動派遣當事人間的法律關係及權利義務,在法律關係部分,除參考學者及研究外,並特別對於派遣雇主與要派人間,因派遣服務費之給付方式不同而產生的三種要派契約類型,並藉由與勞動派遣近似之其他制度作一比較,以歸納出勞動派遣之特徵;其次,在權利義務方面,以區分為主給付義務與附隨義務方式討論之。第二部分,透過實務訪談方式,了解勞動派遣在實務上應用現況及所產生的問題,例如,定期契約的問題,派遣勞工的權益保護等,經由彙整討論後,提出本文見解或建議。第三部分,首先參考外國的立法概況,針對我國勞動派遣法的立法必要性與立法模式探討,以及對我國現行幾個主要勞動派遣法草案版本內容作簡單介紹及討論,並嘗試對於幾個本文認為應特別注意之處,提出具體建議,以供未來立法的參考。 最後總結前述各章節的討論研究,歸納後並提出幾點建議,以作為本論文的結論。首先,對於實務問題的提出,目的在彰顯現行法令規定對於勞動派遣實務上的落差,例如,在雇主責任問題,包含給付義務、職業災害責任及侵權行為等,本論文支持採共同雇主概念,派遣雇主與要派人均應負連帶責任,並應於未來立法條文中明定。其次,關於派遣勞工之權益維護問題應從二方面思考,一是對派遣機構之規範。二是對派遣勞工之教育。再者,參考各先進國家的立法概況,以及我國國情,應以立法規範方式制定勞動派遣專法,可對勞動派遣有較為完整而一致性之規範。

Abstract The title of this thesis is A Study on the Issues of Dispatched Employment in Taiwan. The researcher aims at exploration on the issues in practice of dispatched employment in Taiwan with interviews, reference of documents, books, thesis papers and research reports. Comparing with legislation abroad, the researcher arranges the relevant data in the hope to bring an accurate understanding of dispatched employment which is having increasing attention from this research. Different from the typical employment, dispatched employment is a new manpower employment model, involving the rights and obligations of dispatching agency, dispatched workers and client. The dispatching agency do not directly instruct or supervise the dispatched workers. The client, who do instruct and supervise the dispatched workers, do not have contract relations with the dispatched workers. This situation tends to lead to legal issues in employers’ responsibilities. It is, therefore, an important issue to clarify the rights and responsibilities among the triangular relationship. This thesis paper is divided into three parts. The first part discusses the legal relations and rights and obligations between dispatching agency, dispatched workers and client. Owing to different service payment methods, there are three types of contracts. Comparing the system with similar ones, the researcher concludes characteristics of dispatched employment. As for rights and obligations, the researcher explores main settlement and subordinate settlement obligations. In the second part, with practical interviews, the researcher attempts to understand the problems from dispatched employment in practice and current situations such as fixed-term contracts and protection of interests of dispatched workers. Opinions or suggestions are given after arrangement and discussions. In the last part, the researcher first refers to the legislation abroad and discusses the necessity of legislation and legislation model for dispatched employment in Taiwan. Simple introduction and discussions are submitted on several drafts of dispatched employment acts in Taiwan. The researcher also attempts to point out several points which require attention and offers suggestions as the reference of future legislation. In the end, the researcher concludes the discussions in each section and offers several suggestions as the conclusion of this thesis paper. First, issues of practice are to manifest the gap between the current regulations and practice of dispatched employment, such as responsibilities of employers, including settlement obligations, occupational accidents responsibilities and infringement of rights, etc. The researcher supports the concept of mutual employers. That is, dispatching agency and dispatched workers have to be mutually responsible. This shall be stipulated in future legislation. Second, one shall consider the maintenance of dispatched workers’ interests in two directions—regulations on dispatch institutions and education on dispatched workers. Moreover, with reference of legislation in advanced countries and our condition, we need to have an exclusive, comprehensive and consistent law to govern dispatched employment.
