我國TFT-LCD產業專利佈局之研究

摘要


隨著知識經濟時代的來臨,社會對無形資產的重視提高,尤其對於智慧財產權方面已經成為企業重要的競爭力核心要素,如何利用專利佈局在競爭態勢中取得優勢,便成為一項重要的議題。 薄膜電晶體液晶顯示器(TFT-LCD)產業為國家兩兆雙星計畫之重要產業之一,臺灣平面顯示器產值已於2006年10月底正式突破1兆894億元,成為繼半導體產業之後的第二個兆元級新興產業,但由於臺灣進入此產業較晚,故常被日本、韓國等競爭國家提出專利訴訟,導致我國需付鉅額的授權金或訴訟費用。 本論文主要目的是瞭解企業在薄膜電晶體液晶顯示器的專利佈局的要素、方法及策略,以我國前三大面板廠商為對象,藉由訪談A、B、C公司及運用專利分析方法探討此三家公司於美國及臺灣的專利之分析圖,加以討論,最後,針對我國TFT-LCD產業之專利佈局提出建議。 本研究結論分為以下三點:在專利要素方面,暸解到專利數量為公司內重要因素,且專利是高層相當重視策略。另外,在專利方法方面,公司內皆以跨部門的評定方式去判斷是否申請專利,且皆不使用時間佈局。最後,在專利策略方面,三家公司皆認同產業鏈共同佈局具有威力且應當執行,但目前尚有必須突破點,其突破點大致分為兩點:第一為不同組織間仍有其決策者,無法完全跨越組織去共同執行專利佈局。第二為專利訴訟時仍必須以公司對公司去面對判決,故即使共同有佈局,面對訴訟時仍然以單獨個體為主,母公司只能在背後支持。 本研究建議分為以下三點:1.確實運用TFT-LCD產業聯盟的力量2.建立企業與國家差異化策略3.產業鏈的專利共同佈局,我國若能結合國家與企業間的力量,確實提昇我國於TFT-LCD產業的專利數量與品質,便能漸漸地提升我國在專利佈局的不足之處,亦能減少被控訴的機會,提升我國TFT-LCD產業之價值。

With the advent of knowledge economics era, our society increases attention to intangible assets, especially in Intellectual Property (IP). IP has become enterprise's important key competitiveness. Therefore, how to stand on a vantage point in competition situation by patent deployment has become one of the essential issues. The thin film transistor liquid crystal display (TFT-LCD) industry belongs to one of the “two trillion and double stars” industry, which have been proposed by the government. At the end of October 2006, it’s output value broke through NTD 1 trillion and 89.4 billion, and TFT-LCD industry become the second following industry of semiconductor which get to 1 trillion. However, our country enters TFT-LCD industry later than other countries, such competition countries as Japan and Korea. It led to our country need to pay huge charge in authorization or expenses in litigation. The aim of this study is to understand our enterprise’s patent deployment, especially about important fators, process, and stragegy in TFT-LCD industry. This study applys the interview method and patent analysis to inguire situation toady and suggest strategy for TFT-LCD industry in Taiwan. This reaserch has three conclusions, as follow as below: first, numbers of patent is very important, and high level managers also focus on patent strategy. Second, these three companies used different people of department to decide whether claiming patent or not. Finally, they all thought that patent deployment with industry value chain must to do, but we should break through two points, first is barriers of frame from different organization and which company should face up to litigation. This research also has three suggestions, as follow as below: first, using our TFT-LCD industry association as more as possible. Second, making differentiation strategy between companies or other competitive countries. Finally, if we could combine country and company’s power to make patents with industry value chain, it will create more powerful patents in the world.
