促進公有土地參與都市更新之功能及問題研究-以臺北市為例

摘要


都市更新為臺灣未來都市發展之重要方向,我國之都市更新早期係由公部門推動但因成效不彰,近年來轉為獎勵民間辦理。由於公有土地取得困難是民間辦理都市更新的阻礙之一,因此1998年11月11日公布之都市更新條例第二十七條特別規定公有土地一律參與都市更新,期俾利都市更新事業順利推動,達成都市整體發展之目標。然而,公有土地參與都市更新之情況如何?公部門與私部門互動關係為何?及其參與方式對都市更新政策有何影響等議題皆缺乏文獻深入探討。 因此本研究首先回顧公有土地參與都市更新之背景及相關法令規範;以臺北市已申請之都市更新237件案例為研究對象,統計其中含有公有土地之案件量及比例等數據,瞭解公有土地參與更新之案件情況;且藉由公部門辦理更新之相關公務人員及私部門相關更新業者進行深入訪談,並以公私協力之概念分析現行公有土地參與都市更新之方式,及探討其所產生問題的原因與影響;且透過代理理論及因代理關係所產生之逆選擇及道德風險檢視公有土地參與更新所產生之問題與現象。 研究發現,公有土地管理機關代理全民處理公有土地參與都市更新,因代理關係之自利行為、風險規避等特性產生道德風險,使得目前以操作簡易的標售為主要公有土地參與都市更新之方式,因此未能以公私協力之精神,充分積極配合都市更新程序,造成許多阻礙都市更新之情況。然而在公部門將都市更新事業交由民間辦理的另一層代理關係下,由於雙方資訊的不對稱、自利行為及目標歧異等因素,使得目前以標售為主要處理公有土地參與都市更新之方式,對都市更新及都市再發展造成更新案中大面積公有土地比例偏高的逆選擇現象。因此,本研究建議公有土地管理機關應與地方政府配合擬定符合雙方目標之條件來評選實施者,使公有土地之運用更具有促進地方發展之公益性;並在處理公有土地參與都市更新時導入公私協力之精神,善加利用公有土地之參與引導私部門辦理都市更新,有助於達成都市整體健全發展之目標。

Urban renewal for Taiwan’s future urban development plays an important role. Early urban renewal in Taiwan was implemented by the government but ineffective. Accordingly, in recent years government rewards private developers for urban renewal. Because acquiring public land is difficult for private developers, November 11, 1998 announcement Article 27 of the Urban Renewal Act define that public land must participate in urban renewal. However, many details of this issue are still unknown. What’s the situation of public land participating in urban renewal? How is the interaction between public sector and private sector? And what’s the impact of public land participating on urban renewal policy? These are all of this research to explore. First, this research review the literature of public land involved in urban renewal of the background, relevant laws and decrees regulating. And counting the proportion and the number of cases of public land of the 237 case which has applied for the urban renewal in Taipei City, adopt in-depth surveys with interviews to public official and private developers which are related urban renewal. To understand the existing manner of public land participates in urban renewal and discussion on the problems it causes and effects. Finally, the research applies agency, Adverse Selection and Moral Hazard to analyze the phenomenon generated by public land participating in urban renewal. The study concludes that public land management agencies act for people dealing with public land involved in urban renewal. Because of moral hazard lead to the sale as the major manner of public land to participate in urban renewal. Therefore fails to meet the spirit of public-private partnership of the urban renewal process, causing many obstacles in urban renewal. Public sector transferred the implement of urban renewal to private sector is another agency relationship. The sale leads to the phenomenon which is adverse selection of urban renewal and urban re-development. There is a higher proportion of large dimension public land the all plans of urban renewal. This study suggests that public land management agencies and local governments should meet the development goals of the two sides to the conditions choosed private developers and using public-private partnership to improve future policy recommendations.
