1993年6月15日立法院三讀通過「公職人員財產申報法」17條條文,並於同年9月1日施行。2007年「公職人員財產申報法」修法,應申報財產之公職人員由原先之33,384人急速增加至51,407人。所謂「徒法不足以自行」,許多政策之所以會失敗,關鍵是在執行的環節上出了問題,而充分的資源則是政策執行成功的要素之ㄧ。本研究旨在探討臺北市政府所屬之政風機構執行公職人員財產申報制度有關經費、人員、權威、資訊、科技等5項資源項目,在充裕度、分配度及支持度3個面向之問題與影響。 本論文參考財產申報相關文獻並以政策執行、資源及財產申報等有關理論為基礎,深度訪談制度規劃決策者、執行者、受規範者及受裁罰者另對臺北市政府所屬政風人員實施問卷普查,將統計資料做交叉分析以印證深度訪談結果,又蒐集各國財產申報制度比較分析,對發現之執行上困境,嘗試提出因應之道及相關建議,期望能在曠日費時的修法途徑之外,另外發展出可參考之路徑。 分析本研究深度訪談結果與問卷調查結果,在各種資源面向有大致相符之趨勢,僅在人力感受上有較大之分歧。對於網路申報方式,不論是深度訪談或是問卷調查皆獲得相當認同之結果,並認為加強網路申報功能有增加效率之正面效果。 本論文根據研究發現提出政策建議如下: 訂定資源規範、爭取長官支持,逐步建立經費使用固定模式、爭取擴大編制員額、成立專責任務編組、檢討執行權威適時補強、提升人員專業水平、推展全國ㄧ致之網路申報系統、發揮統合角色、適時調整方向。
The 17th clause of Act on Property-Declaration by Public Servants went through the entire three-reading procedure in the Legislative Yuan on June 15th and was implemented on September 1st, 1993. An amendment to the Act on Property-Declaration by Public Servants increased the number of obligors from 33,384 to 51,407 in 2007.People say that Law can’t be implemented by itself. The reason why policy to fail are mistakes in policy implementation and one of the key factors to implement policy successfully is the sufficiency of resources. The study is to probe into how the dimensions of sufficiency, distribution, and supportability will be impacted by budget, manpower, authority, information, and technology of Public Servants Property-Declaration System in ethics department of the Taipei City Government. The thesis is based on documents of property-declaration, theory in Policy Implementation, Resources, and Property-declaration System. The statistical data was not only gathered through interviewing with the policy formulators, policy implementers, obligors, and the people been punished, but also the survey from government employees in ethics department in the Taipei City Government. The cross-analysis was used to test and verify the statistical data and then compared with the Public Servants Property-Declaration System from different country. The thesis tries to find out solutions and suggestions to break through the obstacles in implementing the policy and come up with the referral which is different from time-consuming legislation. According to the interview and survey, only the feeling of manpower is different from all dimensions of resources which are consistency with each other. To the internet-declaration approach, the statistical data is positive and shows that it will enhance the efficiency by increasing the function of internet-declaration approach. The thesis concludes policy suggestions as followings: To establish resources regulations, have the support from commissioners, set up pattern in using budget, strike for larger organization, come into existence of dedicated task force, review and reinforce the executive authority timely, improve the specialized level in manpower, popularize the consistent internet-declaration system, elaborate the integrated role, and adjust the direction duly.
