論女性長刑期人犯機構處遇之研究—從法治國刑事政策觀點以論

本文以法家思想經典，亦即前人智慧經驗的累積，參酌書中生活智慧的人生經驗，作為參考研究之探討。再就其他相關刑事司法的研究方法、組合質與量的資料方法，以及比較法學研究方式兼及犯罪學、監獄學之觀點，探討法治國寬鬆或嚴格的刑事政策，對女性長刑期人犯機構處遇問題之影響。再彙整其他相關文獻資料，予以分析、研究探討。研究者為矯正實務工作者，以參與直接觀察蒐集資料之方法，針對處於現在刑事政策重刑化趨勢下，必須長時間監禁之女性長刑期人犯之機構處遇，她們如何面對機構內擁擠、老化、疾病醫療等之問題。以刑事司法的研究方法，兼採質性研究之隨機立意取樣、選擇適合研究目的之個案做深度訪談的方式蒐集資料，並整合研究者本身之實務經驗，綜合前列研究方法，以獲得在研究工具設計下所獲得的資料，以驗證資訊內容之實證性。由於刑事政策的變革，未來女性長刑期受刑人勢必將會大量增加，連帶影響到女性矯正機構的收容結構與機構處遇，勢必將延長女性受刑人的監禁期間，這必然會有超額收容及處遇的問題，相對的也會壓縮收容人原本就很有限的生活空間。這對女子矯正機構必然產生許多問題及衝擊。除了因應未來女性長刑期的收容處遇問題外，對於收容人之重症、高齡化、愛滋病等之健康照護服務與醫療支出等相關面向之問題，將成為女性矯正機構收容高齡化及其他醫療處遇嚴重負擔的問題。然而，在實踐現行的刑事法令，用於犯罪的控制手段時，並應順應世界人權的潮流，不管在任何時間、地點，皆應落實「人權的保障」。尤其面臨長期監禁的女性犯罪者，在監之處遇其人權之價值及保障均不能被漠視。關鍵詞：法治國刑事政策、重刑化、女性長刑期、人權保障、處遇

This article is based on the classic pre-Qin Legalist thought, which the wisdom of accumulated experience, the wisdom and the experience of life from the book as a literature review as a reference. Use of Criminal justice approach, combine with Quantitative and Qualitative, Comparative law research, Criminology, Prison Studies, to discussed loose or strict rule of law in the country of the criminal policy of the female prisoners serving long sentences the impact of institutional. Then sink the whole literature, to be analyzed, and studied. Researcher is a practitioner of Correction institution, to make use of direct observation methods to collect information. Now the trend of felony criminal policy, long imprisonment of female prisoners treatment, and how to face the agencies within their crowded, aging, disease, medical problems etc. Research methods in criminal justice, with Qualitative of the random purposive sampling, and Case depth interviews to collect data, and Integration of the researchers own practical experience, to verify the information content. As the criminal policy change, the future of female inmates serving long sentences is bound to be a substantial increase, bound to extend the term of imprisonment of women inmates, and that there must be at the event over asylum issues, it's also compressed the inmates had very limited living space, impact of many problems and inherent in female correctional institutions. In addition to long-term response to the future of women's asylum case at issue, for the inmates of the critically ill, aging, AIDS and the health care services for the medical expenses and other related issues will be corrected to the institutionalization of women's aging and other medical office case of a serious VIII burden on the problem. However, in practice, the existing criminal law, for the crime control means, and should conform to the global human rights trends, no matter at any time, place, all should implement the "protection of human rights." In particular, face long-term imprisonment of women offenders in prison, and the value at the event and protect their human rights not be ignored.
