2011年10月為臺大法學論叢發行40週年紀念日！40年來，臺大法學論叢提供國內外學者、法官、律師、學生發表法律專業論文，量多質精。在民法方面，發表於臺大法學論叢之論文，包含歷史法學、法制史、比較法、外國判決研究、國內判決研究、立法建議、法律經濟分析及其他等各類。本文從侵權行為、損害賠償、定型化契約及出賣人物之瑕疵擔保責任四部分，說明臺灣民法學說、實務與立法之發展上，臺大法學論叢所扮演之功能。

NTU Law Journal celebrates its 40th anniversary of publication in October 2011. In the last 40 years, the journal has provided a forum for domestic and foreign scholars, judges, lawyers, and law students to publish professional papers. In terms of civil law, the papers published in the NTU Law Journal include the history of civil law, the legal history, comparative law, case studies of foreign judgments, case studies of domestic decisions, legislative proposals, law and economics, and others.Focusing on the issues related to tort, damages compensation, standard form contracts, and the sales warranties, this article elaborates the function that NTU Law Journal has played in the development of the legal theory, practice and codification of civil law in Taiwan.
