農地管制之研究－兼論國土規劃與管制

摘要

農業為國家之根本，人民衣食之源，屬於從自然界獲取天然資源之第一級產業。因此，農業對於土地之依存性遠大於其他二、三級產業之工商服務業，如若將農業轉型為工商服務業，土地原先適於農用之性質往往已經改變，而無法回復。更可見土地對於農業之重要性。近年來許多土地爭議案件，皆是圍繞著作為農地而生。由於土地區位會互相排斥，相較於其他土地，農地因其市場價格相形低廉，成為其他產業及公共建設之首選土地。在此種態勢下，要如何確保我國農地能夠合理規劃，並確保「斯土斯有農」之農業不因土地區位之變動而毀滅，實屬我國應面對之課題。相形對照下，德國面對農地轉用之問題上，由於其國土規劃及管制體系完善，至今仍然保有農村地景風光，值得吾人借鏡，藉由相關體系制度之介紹引進，嘗試檢討我國國土規劃及管制制度，使我國國土能達成更合理之利用規劃及管制。

Agriculture as fundamental source of food and clothing of the people belonging in the country for obtaining the first level of industrial natural resources from nature. Thus, the dependence of the land of agriculture is much larger than the other second, third level of industries of the business and services. If the agricultural transformats to the business services, the nature of land which is originaly suitable for agricultural has been changed forever, and can’t recover again. The importance of land for agriculture is clear. In recent years, many controversial land events are all around the agricultural land. Because land location will repel each other, especially agricultural land with the lower market prices becomes the first choice of land in other industries and public Construction. In such a situation, how to ensure that our agricultural land can reasonably plan and ensure that "Agriculture connects the agricultural land " agriculture is not due to changes of the location of land to be destruct. It is the issue. we should always face. Otherwise, Germany face the problem of agricultural land, due to its great land planning and control system, still retains the rural landscape scenery. It’s worthy of our studying. The relevant system introduced to our country can improve our land planning and review control system, so that our land-use planning and control to reach more reasonable.
