機關辦理統包工程採購之研究

The Study of the Government Turnkey Procurement for Construction Works

摘要


統包係將設計與施工等工作交由同一廠商辦理,具有降低工程界面爭議、縮減工期、提升採購效率及品質等特點,是國際上經常採用的辦理方式。政府採購法第24條將統包法制化,實施迄今已歷12年,機關採用統包方式辦理工程採購,囿於營建管理法規限制,統包商成員多屬臨時性組合,兼以主辦機關普遍以非工程專責機關居多,其委託廠商專案管理者,亦經常發生未善盡職責情形,致衍生諸多機關需求規範訂定不周、廠商評選作業不公、細部設計審查未落實、履約過程減工省料、驗收作業未覈實辦理或履約爭議等情事,無法達到提升採購效率及品質之目標,統包工程採購成為高風險的政府採購,不利於統包制度之推動。 本研究經分析機關辦理統包工程採購現況與執行成效,並從工程生命周期探討機關辦理缺失事項。究其問題癥結,固有可歸責於機關或廠商之因素,惟營建產業採行設計與施工分離制度、統包法制未臻健全、未建立周全之設計品質管理制度、事前評估確認機制未臻周延、選商機制未盡完善、專案管理廠商未善盡職責與教育訓練不足等,均是機關產生執行缺失與統包效益不易達成的重要因素,爰提出調整營建管理制度、修正政府採購法第24條及統包實施辦法、建立設計品質管理制度、加強教育訓練等建議意見,以供政府健全統包法制之參考。

"Turnkey" means the whole construction work process, from designing to building, is assigned to the same contractor. This model distinguished features of reducing controversy between the construction interface, reduction of the building duration, improving the purchasing efficiency and quality, etc., and therefore, is adopted worldwide. The Government Procurement Act Article 24 established the system of turnkey and has been carried out for over 12 years. Due to the restrictions on the construction management regulations, most members of the turnkey contractor are formed as a temporary organization. In the meanwhile, most government entities are non-engineering professional, which means that they cannot fulfill their responsibilities well, even they have entrusted supervision and management of construction to the PCM. Under such circumstances, turnkey procurement for construction works leads to many problems, such as the lack of sufficiently comprehension for requirements of  specification, fairness of the contractor's selection, well-implementation of detailed design, qualified construction work, complete verifications after the acceptance operations. Moreover, it generates many disputes in the performance of the contract, and thus far from its anticipated goals of enhancing the efficiency and quality through the procurement process. After that, turnkey has become a high risk way of government procurement now, and which is detrimental to its future promotion. Not only does this research analyze the current situation and implemented effectiveness of turnkey construction works, but also discusses the imperfections through the life cycle of construction. After the study, we can impute the failure of turnkey to the government entity or contractor, but still there are many other factors, such as the separation system between the design and construction adopted by the construction industry, inadequacy of laws and regulations, lack of design quality management system built by the government, inadequacy of the pre-evaluation and pre-verification mechanism. Besides, the imperfect contractor selection mechanism, poor PCM jobs, and the lack of education and training, etc., are also the important factors for the failure of turnkey system. We propose some suggestions, including of adjusting the construction management system, amending the Government Procurement Act Article 24 and the related regulations, establishing the design quality management system, strengthening training etc., as the references for the government to improve the turnkey system.
