不動產經紀業營業保證基金制度之研究

摘要


不動產經紀業管理條例,於88年2月經由總統公佈實施以來,除了建立經紀人專業制度之外,更從繳存營業保證基金,建立了交易安全保證制度,進而提昇不動產經紀行業服務水準與社會形象。 本研究在保障多數已繳存營業保證基金之經紀業者前提之下,就相關類似的營業保證金繳存制度及不動產經紀業營業保證基金的繳存沿革,深入探討。並就現行管理制度優劣,及是否可能更改為法人管理模式,作法理與法源的深入研究。 本研究以經紀業者為對象設計問卷,就人口(如性別、婚姻、年齡、職位、教育程度、所得與任職區域等)變項,對營業保證基金繳存與否、額度高低、管理委員會組織、本金管理及孳息運用等五個構面統計分析(分別命名為社會性、認知性、關懷性、管理性與專業性)作成結論,了解業者對於現行制度存在極高比例之關心及期待。另從營業保證金變異數分析結果顯示,營業保證金的施行,僅有在所得及教育程度兩項,對社會性方面,因所得程度高低與教育程度高低而在同意度上有顯著的差異之外。其餘各變項及各構面並未有顯著差異。最後經由討論作成建議並期待將來作後續研究。

Real Estate Broking Management Act, promulgated by President order in February 1999, is constituted to establish real estate brokers' professional system, and to implement paying guaranty bond of transaction has set up the safety assurance system of transaction, and then to promote the service level of real estate brokerage and it’s social image. In order to protect the majority of brokers which already paying the transaction guaranty bond, this research will deepen probing into the relevant similar transaction guaranty bond paying system and the history of Real Estate Agents Transaction Guaranty Foundation. A theoretical and legal perspective analysis are applied to evaluate advantage and disadvantage of the current management system, and considering to alter the structure of foundation to be a juridical person. According to real estate brokers demographic variables of gender, marriage, age, position, education, income and working area, the questionnaire was designed to statistically analyze following five dimensions: agreement of transaction guaranty bond paying, amount of guaranty bond, structure of guaranty foundation, management of guaranty bond principal, and management of guaranty bond interest; respectively named social dimension, cognitive dimension, attentive dimension, managerial dimension, and professional dimension. The analysis concludes extremely high ratio of consideration and expectation of current transaction guaranty system among the real estate brokers. According to the analysis of variance of transaction guaranty, only the variables of income and education with social dimension show extremely high difference to the agreement of implementing transaction guaranty. For the rest of other variables and dimensions show no obvious difference. After discussions, the research will make some suggestions finally, and expects to do further research in the future.
