建構符合高科技廠商之專利管理公司經營模式

摘要

專利訴訟的賠償金屢屢創出新高的紀錄，造成專利訴訟年年增加主要來自於專利管理公司的興起，專利管理公司對全世界各公司發動的專利訴訟，已為各產業帶來巨大的威脅與衝擊。為了維護各國產業發展的秩序，各國政府開始對智慧財產權產生高度重視，希望藉由專利權管理機制的建立能降低廠商面對訴訟案件的威脅。
專利管理公司經營運作模式中存在許多特性與服務項目要素，各要素的搭配與運作是否有效率，關係著專利管理公司的營運效率與服務項目是否可被高科技廠商所滿足。
本研究透過個案研究、訪談及問卷調查廠商的需求因素，最後提出符合廠商需求的專利管理公司的經營模式。透過國內外現存之專利管理公司彙整出11項服務項目，分別為投資新創且具發展潛力的公司、購買產學研的各項專利，以買、賣、授權專利為主要營運模式、協助發展產業鏈的模式，產生群聚效益、客製化的專利權生命週期管理、會員制度的專利購買與授權、專利價值評估、對有價值的專利權做商品行銷策略、發動專利戰，收取權利金、授權金與賠償金等、擴大管理公司專利的組合，建構專利資料庫、建構一套有效率的專利品質管理、專利佈局與分析等共11項的主要服務項目。本研究藉由因素分析主成分法提出了廠商的主要六項需求項目，分別為技術研發與專利訴訟分析、專利鑑價與檢索服務、專利佈局、專利取得與授權、專利基金與專利權運用與會員機制等主要六項因素，最後結合兩項研究提出了符合國內廠商需求的專利管理公司經營模式。
本研究提出的新模式是以「建立專利資料庫」為營運核心方向，搭配所衍生出的需求服務項目使高科技廠商能獲得需求。專利資料庫的建立可提升產業與企業的競爭力，也降低專利訴訟帶來的威脅。專利資料庫的專利權來自各國產學研與專利管理公司，透過專利權取得建立符合廠商需求的專利資料庫，與透過後續的專利權移轉將使企業能更有競爭力，專利訴訟威脅的降低使廠商能更專注經營策略的發展。

Patent litigation creates new compensation records because of the patent management company. Besides, Patent management company has been threat to the industry. In order to protect industries, governments have begun to focus on the intellectual property; they hope could reduce the harm of the patent management company.
Patent management company business model have many services and it could satisfy with the demand of the high-tech company.
This study uses case studies, interviews and questionnaires to survey manufacturers demand factors. Case studies and interviews find out 11 services, invest new company, purchase various patents and licensing, development of the industry chain, patent life cycle management, the membership system management, patent valuation, patent marketing strategy, patent litigation, establishment of patent databases, patent quality management and patent strategy analysis. Furthermore, this study also uses factor analysis to find out 6 main factors, R & D and patent litigation, patent valuations and search service, patent strategy analysis, patent acquisition and licensing, patent funds and membership system.
This study proposes a new business model based on "creating a patent database", the services provide for high-tech manufacturers. The patent database could improve the competitiveness of industries and enterprises; reduces the patent litigation threat.
