The DOI link will always direct you to the most updated article page no matter how the publisher changes the document's position, avoiding errors when engaging in important research.

Cite a document with DOI

國民學校公辦民營之研究
論文摘要
本文首先以經濟學的角度探討國家在教育中的角色，論述國家介入市場活動的時機，認為政府介入教育事務，在程度上應盡量尊重市場，只有在私人所不能達成的情況下，才考慮介入，而非一味地扮演積極生產的角色。因為政府的過度介入，可能只會帶來更嚴重的「政府失靈」的問題。況且「市場失靈」只是政府介入市場的必要條件，而非充分條件；政府強行的干預可能不僅無法使市場機能發揮，甚至還會導致資源的誤置，而付出更大的代價。
由於國民教育具有外部效果的特性，以及為保障教育機會均等與社會公平正義的原則。國家有責任提供人民接受教育的機會；但必須體認「教育」不等於「學校」，「補助教育」也不等於「補助學校」，「國家介入教育」更不等於「國家來經營學校」。
現行的公立學校由於經費來自於政府預算，加上受到政府的保護，因此無論其經營的好壞，都不至於倒閉，使得經營績效不彰。近年來提出的學校「公辦民營」就是希望透過民間企業經營的方式來改革公立學校，主要是希望減少科層體制的限制，提昇辦學的自主性與創新性，增加家長學校選擇權。
學校「公辦民營」的模式，至少包括：「委辦學校」與「教育券」兩種。其中在國外實施的最為廣泛與成功的即為「委辦學校」，其主要是希望使具有教育理想的教師和家長也有機會建立其理想中的學校類型。學校必須對學生成績的改善負責。經營者除必須要達成所承諾的教育目標與成果之外，可免受許多教育行政法規的約束，並依其本身需要遴聘人員，彈性使用經費。委辦學校本身仍屬公立學校，而其所需經費依據學生人數由政府教育經費中支出，而學校亦須如同一般公立學校一樣，接受所有學生，不得有所限制。
委辦學校除可提升學校經營績效、減少科層體制的束縛之外，更能符合多元社會的需要，建立新的學校經營方式與學校文化，提昇教育品質。但委辦學校本身也受到許多質疑。包括：擔心造成另一種教育機會的不公平，反對者認為因為是屬於民營，委辦學校負有教學表現任務，對於程度較低或特殊教育的學生，可能就會被忽略。第二是擔心承辦者過於重視利潤之獲得，而忽略了教育目標之達成。第三則是委辦學校被認為會吸引所有最好的學生及家長；而留下一些資質較差或問題學生以及不關心子女教育的家長給公立學校，形成一種「菁英教育」的現象。此外，也有人質疑委辦學校並不能保證學生能夠接受合適或高品質的教育；學生的教育權益可能無法獲得保障。但就美國委辦學校實行的經驗來看，委辦學校不僅沒有上述的現象產生，甚至比傳統的公立學校服務更多少數族群、殘障、低度學習和高危險群的學生。
美國的委辦學校在發展過程中，曾面臨一些困難和問題，其中經費與教學設備的缺乏是最普遍的，其次，政治團體的抵制與法律的限制、內部的紛爭與教師協議等問題也都是亟待克服的事項。因此，委辦學校要能成功，也須有其政策面與實施要件的配合。例如：教師與家長對學校的選擇權、金錢的補助必須直接用以選擇學校、學費的自由化、國家對於教育市場機能的尊重以及學校辦學的責任與自主性等。
本文也探討了美國委辦學校的運作過程、發展過程與實施概況，並舉出幾所辦學相當成功的學校。美國自從1991年明尼蘇達州首先通過委辦學校的立法之後，估計至1999年止，全美將超過1000所委辦學校。加拿大亞伯達省，也於1994年成為該國第一個通過委辦學校法的省份，其學校數並由起初不到70所增加到300多所。香港於同年度（1994年）也成立了第一所公辦民營的「香港教師會中學」。中國北京也將於今年（1999年）出現全國第一所公辦民營的職業學校。公辦民營的學校儼然已成為21世紀教育的新趨勢。
此外，本文並針對「營利與教育品質」是否相容的問題進行剖析，我們認為這兩者不但相容，而且是相助益的，因為利潤的動機加上家長對品質的要求，是教育品質的保證。其次，就「消費者」層面而言，家長對學校的選擇與監督是學校提高品質的重要因素。第三則是國家必須建立「多元」、「學費自由化」與「訊息充分」的教育環境，以達到教育的自主、多元與創新。
「公辦民營」元是企業經營的理念，在確保教育品質的同時，政府可審慎的考慮將其實施於學校教育上。因為除了其本身所具有的多種優點外，對於台灣的國情也相當適合，加上因免除了設校所需的的龐大經費，與教育法規的束縛，使得辦學者更有發揮的空間，對於私人興學也具有一定的指標作用。台灣的教育基本法已於立法院三讀通過，對於各項教育改革的工程，無疑是重新點燃了新的希望。但願在未來，改革的種子都能因此而生根發芽，期許這部基本法能賦予台灣跨世紀的教育新生命，「有夢最美，希望相隨」。
