不動產政策與都市開發之研究-以信義計畫區為例

摘要

不動產政策係政府對於不動產之管理作為，屬於公共政策之一部分。本研究將探討不動產政策之性質以及形成、發展、執行。政府對於都市不動產之管理，將為討論之重點，同時將探討都市開發此一主題，探究其中之缺失以及改進方式。
台灣之都市開發，存在著許多問題。如以都市開發為名進行不動產價格之炒作、以都市開發為名進行不動產所有權之改變。都市開發原為關心市民利益，卻成為部分開發商獲得利益之藉口。
本研究以信義計畫區為例進行探討。信義計畫區之開發特色，為都市設計制度之實施。本研究將對信義計畫區進行個案檢視，從信義計畫區之開發經驗檢驗台灣地區之都市開發。對於信義計畫區之個案檢視，本研究將以深度訪談法訪問學者專家，以其意見為論述之佐證。
以信義計畫區之開發經驗分析，都市開發事實上並非全然為政府不動產政策運作之結果，而是經濟的繁榮、社會的發展及文化的建構所造成之結果。本研究之發現包括：信義計畫區係政府主動開發之重要案例，都市計畫對新市鎮之規劃尚欠周全，而都市開發經常成為土地所有權人改變土地用途之結果，都市計畫尚欠缺專責機關，台灣之都市開發亦欠缺對環境與公共政策間之互動關係。

Reality policy is a part of public policies, which means the management of real estate by government. A study of reality policies will treat the public policies, and the arising, advancing, executing of the policies.
There are many problems in the urban development in Taiwan. Private developers always take urban developments as an excuse to bull the real estate markets. Basically, urban development will increase the happiness of the citizen. But now, becomes a tools for bulling the reality market.
The study will treat a case study of Shin-Yi planning area also. The characters of Shin-Yi planning area is urban design. The study will take Shin-Yi planning area as a case to observe urban development in Taiwan.
The experience of Shin-Yi planning area tells us that urban development is not all about the government’s reality policies.Social development、economy、cultural activities will affect urban development. The study result as follows:
1.Hsin-Yi planning area is the most important case developed by the government.
2.Urban planning laws are not good enough for new urban area.
3.Urban development targets didn’t match social development.
