The Blue Bird-五個性剝削少女的安置經驗及與制度對話

摘要


本文目的在於探討五位被安置之性剝削少女,安置經驗在她們生命經驗過程中的意義。透過深度訪談,收集這些性剝削少女的生命故事與安置經驗,分析安置經驗在她們人生歷程的影響與角色。 台灣傳統以來,視兒童為親職關係一部分,兒童被視為是無獨立能力與權利的個體,因此,受性剝削之少女及其安置制度亦反映此種規約式思想。國家被視為監看少女行為之機制,而非權利保障之機關。 研究發現安置制度確實有存在的價值與其必要性,然而由於家父長式的意識形態及機構管理規訓需要,這些制度逐漸僵化失去彈性,脫離原先預設的立場,因此必須回到「兒少最佳利益」的核心價值,重新檢討和修正。本文希望能為兒童及少年性剝削防制的制度帶來一些思考方向,並供往後的政策發展作為參考。 本文藉由訪談五位性剝削安置少女的生命經驗,檢視現行性剝削安置制度對安置少年生命歷程的影響,並藉由批判反省作為政策執行者的社工處遇服務,探討可以游走於制度和主觀價值間的能動性(agency)。

Through the placement experiences of five sexual-exploited placement girls, we aim to explore the meaning of placement in the girls’ life courses. We collect the life stories and placement experiences of these sexual-exploited girls through in-depth interview, and analyze the potential impacts and roles that the placement experience could have on the girls’ life courses. Paternalism towards children is a traditional phenomenon in Taiwan. Children are considered as individual bodies without independent capability and right. As a result, sexual-exploited girls and their corresponding placement system reflect this same kind of disciplined ideology. The country serves as a mechanism to monitor the girls’ behavior instead of an institution to protect the girls’ right. The results show that sexual-exploited placement system does have its value and necessity, but gradually losing its elasticity under the paternalistic ideology and the requirements of institutional discipline management, away from the original position that the system preset. Therefore, we must review and regulate the sexual-exploited placement system, back to the core value as in “the best interest and advantage of children and youth”. We expect the observations and outcomes of this thesis can provide alternative directions for future policy development regarding prevention and control of children and youth sexual exploitation. We access five sexual-exploited placement girls’ life experiences to inspect impacts on life courses placed under current youth sexual exploitation placement system, and try to explore the agency between institute and subjective value.
