行政檢查

鑑於我國學界對於行政檢查之理論課題之檢討，尚有不足，且立法課題之討論，亦尚有發揮之空間，本文乃全面性檢討行政檢查。首先，檢視國內幾種行政領域法制之行政檢查規範之現況，為使行政檢查之一般論更為客觀及周延，檢視之行政領域包括具濃厚的積極行政性質之食品衛生行政、藥品管理行政、消費者保護行政，以及具濃厚的消極行政性質之警察行政。因此，就食品衛生管理法制、藥品管制法制、消費者保護法制及警察法制之行政檢查，嘗試確認其檢查方法或態樣、性質、正當程序及檢查後之處置、救濟等。其次，檢討行政檢查之主要論點，包括行政檢查之定位與性質、行政檢查與法律保留原則、行政檢查與行政上一般原理原則之關係、行政檢查之正當程序、行政檢查與行政決定之關係、行政檢查之救濟。其中救濟又可分為對於檢查結果之救濟、對行政檢查方法、程序等之不服、檢查請求權。最後，提出行政檢查之立法課題。1.包括與其發展一般行政調查法，不如發展個別行政領域之行政調查法制；2.全面檢討個別行政領域行政檢查之法律保留；3.個別行政領域之行政調查應全面賦予正當程序保障；4.個別行政領域之行政調查應全面賦予適當之救濟。

Because it is not examined sufficiently about administrative investigation in Taiwan, in this paper, I examine legal system and legal doctrine of administrative investigation completely. First, I inspect the present condition of administrative investigation in some legal system of administrative activities of Taiwan, including to active and passive administration, and there are food hygiene administration, drug regulation administration, consumer protection administration, and police administration. In these legal systems, I put investigation method, due process and remedy of investigation in order. Second, I examine the important legal issues about administrative investigation. Including to place of administrative investigation, relation of administrative investigation and rule of law, relation of administrative investigation and administrative general principle, due process of administrative investigation, relation of administrative investigation and administrative decision, remedy of administrative investigation. Finally, I submit the subject of administrative investigation in the future.
