我國私校高等教育退場制度之法律探討

由於國內高等教育的普及化，使得高等教育已經達到飽和，台灣的高等教育發展至2007年統計將近有164所大專院校。但高等教育數量快速擴張的結果，雖滿足社會大眾對於高等教育之需求，但是造成高等教育素質的大幅降低。另一方面高等教育經費的擴張、國內出生人口逐年下降，均造成國內各大專院校在招生學生來源上面臨困難，使得高等教育市場出現供過於求的現象。因此本文主要可分成五部份，第一部份先討論私立大學的設立與法律地位，第二部份討論大學退場機制的涵意，第三部份討論新修正的私立學校法對私校退場的影響，第四部份討論評鑑結果與退場機制關係，第五部份談到私立大學的退場困境，最後提出對私立大學退場困境的解決建議。

Owing to domestic popularization of higher education, making higher education has reached saturation. Taiwan's higher education development to 2007 statistics there are nearly 164 institutions. The rapid expansion of the number of higher education a result of significantly lower quality of higher education, On the other hand with the expansion of higher education funding with domestic-born population decreased year by year caused by tertiary institutions in the domestic sources of student enrollment is facing difficulties. Finally higher education will have a market imbalance. This article from the legal point of view of Taiwan's system of private schools exit mechanism a total can be divided into five sections: The first part discussed the establishment of private universities and the legal status. The second part discussed meaning of higher education exit mechanism. The third part of the discussion of new amendments to the private school law on private schools withdrew the impact. The Fourth part discussed between evaluation results and the exit mechanism relations. The fifth part discussed the difficulties of private universities on exit mechanism. Finally, propose the solution difficult position on private universities exit mechanism.
