摘要

台灣公投法建制過程相當久，相關職司蒐羅不少先進民主國家的制度，並以之作為制度安排的參考典範，實質地展現制度移植的痕跡。本文首先鋪陳這項移植的屬性，用以明晰其內蘊及變化。
本文的第二個焦點在於：運用前瞻性評估、史瓦特分析及推廣性評估等三項策略性評估，分別鋪陳各項評估所指涉的面向，以及其各自在公投制度化上釋出的運作情形。
而在公投最後立法的樣態出爐後，顯已露出要再移植的制度因子，本文亦趁勢將其提出，以為公投永續演化、優質深化的標的。

Five problems are addressed in this paper. First is to construct six characteristics of institution transfer. They are: knowledge management, inter-regional application, informed decision-making, contextual consideration, typology of classification and change of transfer.
Second, the paper takes institution transfer as a form of prospective evaluation and analyzes its six dimensions: scope of information, adequacy of information, similarity of problem, institution performance, difference in setting and information utilization.
Third, this paper attempts to use SWOT framework to analyze the strength, weakness, opportunity and threat of referendum act under the constraint of internal and external environment.
Fourth, generalization evaluation is used to expose normative implementation environment of referendum act in Taiwan.
Fifth, another institution transfer is advocated and main directions of retransfer are also mentioned.
