摘要

本文係以社會法理念及其法結構為研究核心，籍由社會法本質與法體系之討論以探究我國社會法制之困境與未來之發展方向，論述之重點尤其強調社會法具公法及私法雙重特性並思索回復其法本質之途徑。本文首先說明社會法之意義、特質與功能等基本觀念，並分析社會法與其他法律之關係，再據以檢討我國相關法規範與法政策之妥適性，試從基本概念之分析為啟始，以提供對於上述問題之思考方向與對於困境之解決途徑。本文之論述略分成三大部分，第一部分探討社會法之基本理念，藉以闡明社會法之法律性質，再從我國法體系之結構中分析社會法與其他法律領域之關連性，從而得知社會法之一般機能與作用，第三部分則以前二者為基礎，評析我國現行社會法制之概況以及思索未來之發展方向。

This essay is focused on principles and the legislative structure of the Social Security Law. In order to inspect obstacles of and prospects for the developments of Social Security Legislation, it is essential to discuss the nature and configuration of the Social Security Law, especially emphasizing on its public-and-private double-phased character of the Law. The essay begins with defining the Social Security Law as well as elaborating the integrities and functions of the Law. It is continued to search for interactive relations between the Social Security Law and other Laws. The main aim of this study is to examine the appropriateness of the contemporary social security policies and legislations by analyzing basic legal concepts, following by investigating the relevant problems and solutions. It is composed with three parts. The first thrashes out basic legal concepts of the Social Security Law to clarify its legal nature. The second explores the relevance of Social Security Law and other divisions of Law within the whole legislative system for a thorough understanding of the purposes and utilities in the Social Security Law. On the basis of the pervious analyses, the concluding comments on the existing Social Security Legislation with the view to offer proposals for future developments.
