跨國婚姻媒合業之探討

跨國婚姻媒合業本質是媒合「雙方不同國籍」的單身男女踏入婚姻，以追求商業利益為目的，只須撮合婚姻結合即告任務結束。一般而言，女性願意接受國際通婚的原因，大多以經濟做為主要考量，此種經濟考量的跨國婚姻中，婚姻模式通常多為外籍女性配偶遠嫁他國，且多數為較低度發展國家婦女嫁往較高度發展國家。因雙方缺乏長期相處，感情基礎不穩定，婚姻美滿度及對該段婚姻的了解，相較同地自由戀愛者仍有差距。傳統媒妁是尋求「門當戶對」，而跨國婚姻之媒合業在商業利潤追求下，卻視婚姻及當事人為商品，對於婚姻制度帶來的衝擊不可謂不大。本文以跨國婚姻媒合業之緣起與沿革為發端，介紹我國跨國婚姻的現狀，探討規範之法制，企希相關機關能使國民真正獲得憲法保障的婚姻及正視職業自由。

The nature of transnational marriage broker industry is to perform matchmaking of ＂single men and women of different countries＂ and lead the well-matched couple to marriage. The industry aims at pursuing commercial profits; and once the well-matched couple is married, the mission ends. Generally speaking, the reason for females to be wiling to accept international marriage is that they mostly take economic conditions of the males into consideration. For such transnational marriage with economic consideration, the model of marriage is usually like that females get married with husbands of other countries far away from their own countries, and a majority of the models are that females of less developed countries marry husbands of more highly developed countries. Since the period of time for the two parties to get along with each other is not long, the foundation of their relationship is unstable. The happiness of their marriage and their understanding of this marriage are not as great as those of the couples who enjoy free love in the same country. Traditional matchmaking stresses that ＂families of the two parties should be of equal social status.＂ However, under pursuit of commercial profits, transnational marriage broker industry takes marriage and the people concerned as products, which actually bring not small impacts to marriage system. The paper firstly reviews the origin and course of development of transnational marriage broker industry, and then introduces the current situation of transnational marriage in Taiwan, and also explores the legal system of the related standards. It is hoped that the related departments can make citizens really acquire a marriage that is protected by the Constitution, and face squarely the issue of freedom of work.
