摘要

2008年由國民黨馬英九先生贏得總統大選，在競選期間，相繼提出「兩岸共同市場」以及簽訂「兩岸和平協議」等的政策，外界對未來的兩岸關係亦多抱持樂觀的態度。「和平協議」(peace agreements)為和平研究(peacestudy)的重要議題，指的並不是單純停止紛爭、停戰協定而已，而是在於紛爭停止後如何維繫和平的各種原則與措置，同時確立國家內部重建的秩序，據以描繪出以和平為目的的國家方向：對內如何管轄國內的紛爭事項，對外更包含與國際各國間關係的和平對應方式。「和平協議」從政治的角度觀看，乃是由軍事、武力的途徑解決移向政治上和平協力合作的面向，是將和平制度化的一種建構(structures for the institutionalization of peace)，更且「和平協議」在一定的程度上，會反映出該地域的政治現實，同時亦作為形塑和平發展的政治與法律之基盤。
承上，本文擬以建構「和平協議」的可能性與挑戰為題，逐一剖析「和平協議」的論理，首先在原則下，對「和平協議」所面臨的正當性以及解決紛爭方法論等兩大議題，提出另一思考途徑；此外，針對台灣的未來和平發展途徑，對「和平協議」的運用，提出建議與思考之道。

The KMT's candidate Ma Ying-jeou has won the presidential election 2008 in Taiwan. During the campaign, Ma has proposed the idea of ”Cross-Straits Common Market” and ”Signing Peace Agreements” from the both sides between the Taiwan straits. Most people are expecting an upgrade of the relationship between the two sides of cross-straits. The idea of ”peace agreements” is a major topic for peace study. It means not only to stop the war but also to create an astrosphere for peace, both internal and external. In the view point of politics, peace agreements are some way to shift the focus from military and force to peaceful political cooperation in term of resolving the difference between the both sides. In other words, peace agreement is one way to structure for the institutionalization of peace which reflect the political realities and will become the cornerstone for peaceful developments.
In this article, I will analysis the possibilities and challenges for structuring peace agreements between the two sides of the Taiwan straits. By reviewing the theories of peace agreements, discussing the ways of resolving the conflicts, hopefully we can understand more about ”structure for the institutionalization of peace”.
