通過減少提供個人資料以解決個資洩露事件 - 以foodpanda應用程式為例

摘要


近年來,當各國政府都在立法保護個人資料時,在美食外送行業的個人資料洩露案例持續增長,例如台灣的《個人資料保護法》和歐盟的《一般資料保護規範》,仍無法阻止個人資料洩露。在台灣,foodpanda的外送員獲取了消費者的聯絡資料後騷擾用戶,在歐盟,儘管消費者已經有八年沒有使用該公司的服務,仍然收到許多來自Deliver Hero Se的垃圾郵件。現今,除了討論和立法保護個人資料的法律外,通過平台減少個人資料收集來降低個資洩露問題至今仍未開始研究。本文旨在研究導致個人資料洩露的原因來自平台收集消費者的個人資料超出了該平台的需求,個人資料提供者缺乏足夠的意識而提供過多的資料給平台,政府應加強那些個人資料安全法規,這些都將通過文獻綜述,受訪者的反饋和案例分析來實現。

In recent years, personal data breaches in the food takeout industry have kept increasing. Although governments have enacted legislation to protect personal data, such as the Personal Data Protection Act (PDPA) in Taiwan and the General Data Protection Regulations (GDPR) in the EU, they still cannot prevent personal data breaches. For example, in Taiwan, foodpanda's deliveryman harassed a user after obtaining the consumer's contact information. In the EU, consumers still received a lot of spam from Deliver Hero Se, despite having not used the company’s services in eight years. At present, in addition to discussing and enacting regulations to protect personal data, researchers have not begun to study to minimize the data breach of personal data by reducing the collection of personal data. Therefore, this thesis aims to research the reasons for data breaches with the results from the three questions which are a platform's collection of users’ personal data exceeds the company’s needs, data providers will not have sufficient awareness to protect personal data while providing their data, and regulations about data security shall need to be strengthened by governments. This will be accomplished by means of literature reviews, respondents’ feedback and cases analysis.
