Analytical Study on the NIKE's Patent and Trademark (2005-2014)

摘要


NIKE在世界上的鞋子及休閒市場佔有舉足輕重的地位,尤其近年來超越對手ADIDAS大幅擴張,本研究透過美國專利商標局、歐洲專利局和Thomson Innovation 資料庫,進行NIKE公司2005年1月1日至2014年12月31日之專利與商標資料分析。本研究發現NIKE在相似的商標上設計碼皆有不同,在尼斯國際分類領域上擴及34種分類並主要集中在第25類(衣著、鞋靴、帽子),商品範疇非常廣泛,其不同分類號有各自發展的年代。專利方面,優先權年顯示NIKE發明及設計專利各有不同重視的年代;在技術領域中,研究發現2009年前主要專利分類為A43B並集中在充氣型的鞋底,2009年後A63B技術分類集中在高爾夫球竿桿頭的技術;在Locarno設計專利分類中,NIKE集中登記在第2類別(內衣、女性內衣、女性緊身內衣、胸罩、睡衣)中的其他類(299)。在專利引證分析中,瞭解到NIKE除了進行自身引用外也會被其他科技公司或潛在競爭者引用。最後,在專利家族分析當中,發現NIKE的專利策略應用變化多端,合縱連橫傾向非常明顯。

Nike is the most famous athletic company in the world. In this study, we observed and analyzed the patent and trademark trend of Nike. We discovered that the design of trademark were remarkable in the past ten years. Trademark was concentrated on Nice classification 25. Total spread trademarks were 34. Before 2009, Nike's technology was mainly on A43B, such as gas-filled shoes. After 2009, it was A63B. Believe it or not, it was golf head. For design, Locarno classification 2 was the major field. Not mainly on women's wear, but on other clothes. Nike had patent portfolio in mind all the time. It was very obviously from the priority number analysis.
