海峽兩岸暨香港、澳門警察處理家庭暴力的職責與角色比較

摘要

家庭暴力是國際社會普遍存在的社會問題，世界各國紛紛藉由法律的明文規定，具體實踐反家庭暴力以及對人權的保障。截至今(2016)年5 月止，海峽兩岸暨香港、澳門都已先後完成反家庭暴力的立法，由於警察在預防和制止家庭暴力過程中扮演了至為重要的角色，故於此際做兩岸四地警察職責與角色的探討，有其重要意義。本文藉由兩岸四地警察在反家庭暴力中的各項職責及角色功能分析比較，期待有助於警察任務的達成，更期盼在反家庭暴力上，兩岸四地都能創建一個安全平等、無性別暴力、重視人權的和諧社會。

As the domestic violence a prevalent, global social issue, countries around the world in droves practice the opposition of domestic violence and protection of human rights by the express provision of laws. Until May of this year (2016), Mainland China, Taiwan, Hong Kong, and Macao had legislated against domestic violence in tandem. Since the police play critical roles on preventing and suppressing domestic violence, discussing the roles and duties of police of the cross-strait area at present is significant. By comparing the responsibilities and characters of the police in the cross-strait area, this article aims to support constabulary missions and build a better world which has no domestic or sexual violence but instincts of equality and harmony and values the human rights in the cross-strait area.
