山坡地違規使用管理之結構性探討

Management System Assessment for Illegal Slopeland Development

摘要


山坡地開發利用影響水土資源、自然生態景觀及民眾生命財產安全。現行山坡地管理制度除針對山坡地合法申請開發案件採取一系列之審核許可及監督檢查作為外,另一個重點是,對於從事未經核准之山坡地開發、經營或使用行為時,能即時予以制止,施以一定之處罰,目的在於避免違規行為造成環境安全之破壞,並要求進行必須之整復。 於山坡地範圍內,從事開發、經營或使用之違規行為範疇,包括依法應擬具水土保持計畫送請主管機關核定者,已擬具並核定水土保持計畫,卻不依核定計畫施工;或未先擬具水土保持計畫送請主管機關核定而擅自開發、經營或使用者;或依法免擬具水上保持計畫,但應向主管機關申請核可而未申請者。 為確實制止山坡地違規開發行為發生,需掌握全面性之山坡地開發即時資訊,並對山坡地使用者之決策模式建立多元化之認知評估與提供輔導管道,不能僅依賴單一查報取締體系之運作。同時政府機關對於合法申請開發案件之種類與程序、簽證、權責,如何更簡政便民,抑或應加重違規處罰之遏阻功能等,更有待審慎檢討衡量。

Soil and water resources, natural landscapes, public safety, and private properties are deeply influenced by the slopeland development project. Currently, there are two major ongoing efforts for the current slopeland management system. One is investigation, approval, and supervision of legal slopeland development applications. The other is the prohibition and punishment of illegal slopeland development. The main purpose is trying to prevent illegal behavior causing environmental safety destruction. Furthermore, the deteriorating environment needs to be restored. According to the regulations, the development, management, and utilization behaviors of slopeland areas requires the proposing of a soil and water conservation plan in order to obtain permission from the local authority. Violation cases include not following the approval plan when implementing the development project, or proceeding with illegal development and management. Further, utilizing resources without permission or not applying for permission in advance even if there are regulations allowing no soil and water conservation plan proposals. In order to prevent illegal slopeland development, integrated slopeland real-time data for management system is critical. The slopeland policy-making model should be established on multiple assessment technologies and properly provide consultation to slopeland developers. It should not only rely on the investigation and enforcement system. In the meantime, authorities need reconsider the categories, procedures, approvals, and responsibilities for legal application. The question of how to offer greater convenience to applicants or reinforce regulation punishment to prevent violation still requires further discussion and consideration.
