影音網站著作權侵害與過濾機制衍生爭議之研究

摘要

許多影音網站讓使用者生成內容上傳網路與人分享，而我國著作權法之「ISP之民事免責事由」專章對「資訊儲存服務提供者」提供責任避風港。然而隨著現今網際網路的規模日益擴大，除了網友隨意將未經授權的影片上傳供人分享之外，剛被移除的侵權內容又被網友上傳分享，讓身負網路監控責任的權利人難以負荷。影音網站能否主張確實遵守「通知／取下」程序即已履行法定免責要件而取得責任避風港保護，抑或是影音網站應如權利人要求以過濾機制協助部分承擔著作權人監控網路和通知侵權行為的責任，是本文探討重點。此外，本文也將從比較法的角度，探討美國對於影音網站之侵權責任限制的相關規定，做為我國將來規範影音網站的參考。

Many user-generated video sites allow users to upload their user-generated content to share with others online. Recently, the Taiwan Copyright Act was amended to provide ISP liability exemption to a internet service provider for copyright infringement by reason of the storage at the direction of a user of material that resides on a systems or network controlled or operated by the service provider. With increasing expansion of the Internet and the amount of copyright infringement, copyright holders have difficulties to shoulder the burden of identifying acts of copyright infringement online and want to shift the burden of policing to user-generated video sites. This paper addresses whether user-generated video sites' strict compliance with the Notice/Take Down procedure is sufficient to meet the ISP safe harbor exemption requirement. This paper also explores the possibility of shifting the burden of policing to user-generated video sites by requiring user-generated video sites to utilize the filtering technology. This paper also addresses similar user-generated piracy issues in the United States for future legislative reference in regulating user-generated video sites.
